Default HELP!!! my body is breaking my contract!

Hey girlies... It's been a while since I've posted here, but I've had some great and some really crazy things going on for myself.

Essentially, I need some help now. I was tied into an excellent modelling contract that was actually signed when I was 16 years old, and is valid for 5 years (I am only 19 right now). However, I became severely anorexic, and ended up in a coma for 4 days. My health has been restored, and I was under the impression that the incident made my contract null and void, and well, now I'm 5'2" and weigh 120 lbs. I am not particularly OVERWEIGHT, but you ladies know that in our world, that is WAY too big.

What this post comes down to is the fact that my agency contacted me the other day, and told me that if I am not down to 105 lbs by this coming Friday, they're sueing me for $150,000!!! PLEASE PLEASE PLEASE give me any and every idea you have to help me drop this weight! The only ideas I object to are drugs... I will not do coke, meth, or any other illegal drugs.

    THANK YOU!!!!!!!!!!!

Here's my idea: go call a lawyer.

If you were under the impression your contract was no longer in effect, why are they getting in contact with you and suing you now? What is going on?

You can't lose 15 lbs in a week healthily and they know that full well. This whole thing sounds sketchy to me and I assume a halfway decent attorney could scare them enough with a few phone calls or letters to get them to drop it.

thanks for the advice... unfortunately, 3 different lawyers(my own father being one of them) have already looked over the contract and it looks like I'm pretty much screwed!

Look, you can fight this. There has got to be a loophole. I hope you can get an extension.

IF your doctor says it's okay, do a body wrap, eat fruits and vegetables, and then a few days before weigh-in, take dieuretics. (Natural methods to drain water weight, like apple cider vinegar, or herbal pills...)

I seriously doubt they can really sue you for that much. It sounds like a scare tactic.

This makes me sad because I heard a dancer who was a runway model talk about the freakish things the agents did to keep their models skinny (told them to eat ice, would ONLY let them eat steamed veggies and white baked fish..fired girls for a few pounds of extra weight). I thought she was exaggerating.

Your only chance is probably this:
There is a tenet of contract law based on Natural Law philosophy of contracts called "Unconscionability"in contracts - basically a contract can't be so unfair and dangerous to your well being, and that the stronger party (the agency) took advantage of you.

You will have to argue that you were taken advantage at a young age to get out of this contract or argue that your health is at risk and the contract has to be voided. You will really have to argue that it is against your well being to be binded to this contract.... etc..

If she already has an eating disorder from trying to stick to this contreact, and she has been ordered to lose an unhealthy amount of weight in an impossibly short time, I think this will be an easy case to argue!

i really hope this works out for you in the end....the whole thing is completely fucked up!!! i hope they get raped by goats for insisting that you lose that much weight in such a short time, all while threatening to sue you. did they give you a huge amount of $$ and now want to claim some of it back? did your anorexia develop as a result of this contract specifically? not sure how those details would effect the end result. but please take care of yourself and don't do anything that could result in your being in a coma again. again, i'm sorry you're having to deal with this. your recovery should be the most important thing, and your modeling nazis should be human enough to recognize that...

    Thanks for all the support...

It is in fact a very prestigious company, and I had several great endorsements as a child. It was a very lucrative industry for me, and that is why they are able to go after me for so much money. The sad thing is, that this is not necessarily an uncommon situation in the modelling industry, and they can in fact demand that I maintain my shape and size so that I remain marketable. I did, however manage to get an extenstion during a conference call with the company this morning, so I do in fact have an extra week and a half to get the weight off. I guess the only thing for me to do now is to grab the bull by the balls and go all out!

You were 16? Legally, you can't sign a contract at 16 and be held to it (unless you're emancipated, and even then you'd almost certainly win this in court). Federal law takes precedent over state or local laws, and this is a federal law. There are some exceptions to this (marriage contracts in some states, although even those are almost always unulled if the younger party wishes it), but modeling contracts DO NOT fall under exceptions. Unless this has very recently changed, your parents also cannot sign anything for you that extends past your legal age of consent, as that is legally indentured servitude and illegal in the U.S. (I, too, was a model at a young age, so some of this is from our experiences with long-term contract issues from major agencies). You'd have had to re-sign once you came of legal age to do so if the company was really on the up-and-up. I am not sure what kind of lawyers you're talking to, and I mean no disrespect to your father, but it's simply an unenforceable contract and most lawyers won't need to look any farther than your age when the contract was signed to dismiss this mess as a scare tactic.

As another poster mentions, there are also other legal provisions that make this contract unenforcable. It is unreasonable to expect a woman to have control over how her body reacts to puberty. At 15/16 years old, you are still experiencing puberty. The changes are unpredictable and largely out of your control with the exception of reasonable diet and excersize. Expecting a woman to stay the same size, shape and weight from age 16 to age 21 is simply silly--it is almost impossible due to biology, genetics and other factors outside your control, and no judge is going to deem it otherwise. They can't require your size and shape be controlled for 5 years of puberty because it's a matter of fact that such a thing cannot be done by reasonable means. Most women do not have the same size breasts, for example, at 21 that they did at 16-even if they're the same weight. Many women grow upward, which would change your ideal weight and overall shape. There's nothing you could do about that. You get the idea. Legally, contracts have to be within reasonable & safe expectations to be enforceable. For example, telling a model she must maintain her yourthful look from age 24-26 is reasonable, and in today's age even 24-30 may be considered reasonable if cosmetic options are not prohibited. (botox, etc.). A contract saying that a woman must look the same at 45 as she does at 25 is not considered reasonable within the scope of nature and technology, and therefore not legally prosecutable. Saying a child star, such as Mary Kate when she was on Full House, must not grow more than 2 inches in 4 years is clearly unreasonable as you cannot safely control a child's height over a given time period, and therfore it's not considered reasonable and legally prosecutable. Actually, all of this can even be turned back on the company AND parents, which is why these issues rarely come to any kind of legal action: some of the things mentioned would fall under the category of child abuse, and no reputable company wants to deal with the lawsuits resulting from accusations of conspiracy to commit child abuse.

None of this takes much serious "lawyering," really, and I am somewhat suprised it's even coming up. Child models rarely are given long-term contracts by reputable companies for exactly these reasons. Children, and 16 is still a child, change dramatically as they grow. A young lady of 16 may be very cute and marketable, but may not stay cute and mareteable as her features grow and fill out in puberty. Also, medical conditions can make pretty much any contract null and void, and anorexia is a diagnosable medical condition. If a model was in a car accident and lost her leg, the company could not sue her and win for breach of contract. If a tennis player developed a heart condition and could no longer play tennis even though her endorsement company contracts said she had to compete in 4 major tournaments a year, the companies who endorsed her couldn't sue her for breach of contract. Yes, they can pull endoresements and yes, they can stop her paychecks. That's not the same thing as a lawsuit. Valid contracts from reputable companies will contain safegaurds against these types of things, specifically so the company can pull any cash it's putting into the person (endorsements, training, travel expenses, etc.) out immediately, and put it into someone else. And so that the contract is legally enforceable in other areas.

This modeling company will lose. Your health is more important, so lose any weight you need to in a healthy manner. You'll feel better, you're more likely to keep it off, and there's no amount of cash worth your health or life.

ok- so I agree with everyone here that you do need to contact a lawyer and that you can't loose 15 lbs in that short of a time, BUT--I will give you some suggestions anyways, so hopefully I don't catch flack:
1)wrestlers have to stay in a certain weight class and so they do diets/and dehydrate themselves (FOR SHORT PERIODS OF TIME). check out tips online for how they do this
    2) seaweed wraps: these are the things that supposedly take off inches but it's really just water weight. This probably won't hurt you since you'll just absorb it back on again after the weigh in
    3) check out the posts on colonics, enemas, and fiber treatments--supposedly there's a lot of excess weight in the crap that clings to your innards. This could be another way to take off weight short term.

There's probably some other options, but once again-- be smart, contact a laywer, and in the meantime maybe you can look some of these things up and it will take off quick water weight or some lbs. where it won't hurt you.

    Good Luck!

I don't know; this all sounds a little sketchy to me. Like, if it was such a lucrative experience, why are you stripping now? Just curious.

I'm not a stripper... I just enjoy the advice and topics on this site, plus the fact that the majority of my money is invested in mutual funds and other investments, and therefore I still work to earn an annual income that I live off of.

In response to Shwankie: There are many stipulations in my contract, and regardless as to wether or not it is reasonable for a child of 16 years old to maintain their weight, you must, according to the agency "maintain marketability" At the time, I was 85 lbs, they're not demanding that of me, and according to the doctors they have on the case, being 5'2" and 105 lbs is neither unreasonable nor dangerous.

There is a lot of other fine print involved (obviously), and at the time of my hospitalization my parents were NOT my legal guardians. Unfortunately, because I signed on not only with my agency but with a specific company for which I was marketing, the details are very messy.

It is, after meetings today, begining to look as though I may be allowed until July 1 to lose the weight!

It seems fishy to me too. I mean... if your father is an attorney then why are you asking strippers who have no legal experience as attorneys? If it is real then why not see a doctor instead of asking us

I came to this site to ask advice on getting the weight off, not for legal advice, with hopes that you guys would have ideas that doctors may not recommend.

Be careful with the dehydration thing. I think you are only supposed to do it for 24-48 hours before weigh in. I know definitely that you can't do it for a long time.

Since you now have about 5 or 6 weeks to get the weight off, yu can stop panicking and take your time (sorta) At this point, I think (if it were me) that I would invest in a good, reputable diet doctor and a personal trainer. Follow their instructions exactly, don't try to over-achieve or lose weight too fast, and you will probaly be all right. If you are going to take any diet pills or so on, check w/your doctor and a pharmacist first, to make sure you anr got going into overkill.

Good luck! Let us know how it goes!

Seems to me you want to lose an unhealthy amount of weight. Otherwise you'd be looking into a counter suit. Is this perhaps to get another contract? If you've already gone through anorexia, you don't need our advice on what to eat or not eat. Keep in mind, that with that contract that will obviously make you famous, is going to come dentures. What sort of parents, especially educated ones, condone this sort of behavior?

Stay away from the pills. I say just hit some major cardio and do some weight lifting. Cut carbs from your diet for a few weeks...that's all major stuff...but it'll get the weight off fairly quickly. Since you were in a coma for a few days due to a major eating disorder...you don't know how that weakened your heart or your nervous system. Anorexia and bulimia are both eating disorders that can cause problems with the imbalance of electrolytes to bring on heart problems. So, if you are going to do pills...you need to make sure that you really talk it over with your doctor. DO NOT BUY ANYTHING OTC!!!

Get a big bag of ice/meth because its the only thing that will work. Why would you come here for advice on how to lose 15 lbs in one week, especially if you read this site regularly. Unlike your agency, we actually do have a consciounce and would NEVER advocate you starving yourself.

There has to be a good lawyer who can help you with this.......
