Default Question to the legal eagles

Why is it still illegal for women to be topless as men are allowed today?

Actually, in New York this very point was used as a basis to legalize topless on state/local public beaches ! But in general, female breasts are considered to be a 'sexual' area of the body, where the male chest is not ... which then triggers 'lewdness' laws if female breasts are exposed in a public venue.

I dunno...I'd rather see a woman walking around topless than some fat, old, ugly guy trying to fit his 300 pound body into a pair of junior boy speedos. Now, THAT should be illegal...

    But, yeah, what Melonie said.

Remember, in France during the 1700-1800, it was ok for a woman to show her breasts (and some dresses/gowns were open front...where the boobs stuck out) but for her to show her ankles...*GASP*...that was indecent and subject to public correction!! Nowadays they have nude beaches and no one cares. We are from a Puritan society...so it's going to take a while for them to relax enough to allow people to run naked.

I think in Canada it is okay to be topless in public as long as it is not sexual...

BTW, for men it is illegal to be in a "turgid" state in public (including in a club)... why should
    a natural reaction be illegal?

It's a rule based on a cultural convention, or community mores, not logic.

Nudity is not a trigger for "lewdness". Public nudity is classified as indecent exposure. "Lewdness" has a much stronger connotation, implying a dark motivation for the conduct. A man jerking off in front of children, for example, would be clearly a lewd act. Nude is not the same as nasty, even under our hopelessly puritanitcal laws.

    [same answer for Myssi]

[edit: after further review it seems mere nudity can be considered a lewd act in some states, such as Alabama. God bless the repressed puritans running the USA. This country is seriously getting more and more FUBAR (fucked up beyond all recognition)]
