    Default injured at work

    Hi all, first let me introduce myself, I'm Gypsy and I'm new to this site. I was recently injured at work. I fell off the pole and broke my arm and had to be taken to the hospital for x-rays and to put a cast on it. My question is, who is responsible for paying the hospital bill? Am I responsible for it or is the club? Thanks for your help.

    Wow, good lcuk with that one! Most clubs refused to pay any hospital bills, we are condidered independent contractors so they feeel no liability.
    I would contact an injury helpline and see what they have to say. It's usually free information and they can tell you where to go from there.

    They probably won't pay unless you are an employee. If you can prove your employee status ie. they pay you a wage-- (the other rules are kinda tricky) then you can get workers comp.

    If the pole was faulty then they may be at fault or if it's a requirement of you dancing there that you do pole tricks, they may be liable.

    Find the best lawyer that you can. you may have to pay a consultation fee.. If he thinks your chances are good, follow thru.

    There may be a free lawyers assc in your area. We have Legal Aid here in Atlanta

    Even then it may be hard. You may have to "prove" that doing pole tricks is a requirement of your job. If it's not (meaning that not every single dancer needs to do tricks), then it may be considered a "personal" choice during the work hours which would not be covered.

    Also, if you've signed any paperwork (long, long, long explanations with little tiny writing at the bottom of a page) you may have signed a release clause. Basically, in that long page of mumbo, jumbo legal speak, you are saying that you will not hold the club responsible for any injuries or loss of wages you may incur during your time as a dancer at their club.

    Do the footwork...go see a lawyer...and after that...good luck!

    I don't know . . . at a lot of clubs you never sign anything. They're just stupid that way. If that's the case, you might be able to talk them out of some cash. Just have your lawyer head down there.

    Of course, you will never work at a club in that area again . . .

    Also, how on earth did this happen? really tall pole? I'm sorry to hear about your injury; it must have been just terrible. Here's to a speedy recovery.

    I don't really want to get a lawyer involved because I still want to work at this club and I don't want to piss anybody off. Not to mention that I don't need the lawyer bills. As for how it happened, I was upside down on the pole and when I fell off, I landed right on my left arm hard. I don't get paid by the club so I'm probably not considered an employee and therefore I probably have to pay the bills myself. I did sign some papers when I got hired but I don't remember what they said...it probably said something in there about how they are not responsible for any injuries. Maybe I'll just ask the manager if they have worker's compensation there...thanks for your help so far.

    Workplace injury, questionable employment or contractual relationship with club, no insurance, unknown workplace hazards, medical bills.... you're right a lawyer would be a bad idea....

    But they could have some kind of policy that covers injuries that occur on their property even though it's not a workers' comp issue. Insurance can be pretty confusing. You wouldn't necessarily be suing the club but the insurance company. Just doing a consult with an attorney won't kill you even if he/she charges you, which many don't if they take a lot of contingency cases.
