    Default Is it legal to put a music video on your MySpace page without a licensing fee?

    My cousin wants to put a video of a Concrete Blonde song on his MySpace page, which will immediately start playing when you open his page. Since he is my roommate, I'd rather not be getting a visit from the FBI or whatever LE would be involved, since the RIAA/MPAA both have a major hair up their collective a$$es re: this crap. I just want to know if anyone here knows if it is legal to do this on a MySpace page? I've found a few sites where you can download an MP3 of the song for 99 cents, but only for personal use. I have not found a site where you can download the associated video. So, if anyone might know, would this be legal or illegal? If a licensing fee is involved, I'm sure it'll be a lot higher than he'd want to pay. Thanks in advance!

    Everyone puts them on their MySpace page, it's not a problem. And he doesn't have to pay anything.

    Sometimes the places you link your video from will shut it down, but I think that's the extent of the damage.

    Some bands who have myspace accounts actually encourage you to put their videos on your page. Many will even give you the code and say "copy this!"

    It is illegal unless you have the copyright owner's permission to do so.

    The "everyone else has video's on their pages" argument won't fly in court and you can expect a $30,000 settlement to the RIAA.

    Like the above post mentions - find non-RIAA bands to promote!

    Read the terms of service-- you also agree to pay their legal bills if Myspace gets sued along with you.

    Posting copyrighted material is explicitly prohibited in article 5 of th eTerms of service.

    Myspace is flooded with illegally copied material. RIAA has bigger fish to fry. As does myspace. Anyone notice the flood of commercial sites masquerading as members? Myspace is a clusterfuck.

    What Phaed is suggesting is also completely illegal and falls under both the contractual obligation monty points out, and just plain old country-style copyright infringement.

    Ok, I'm sorry. I was simply stating the facts. I would assume that with all the lawsuits flying around that the sites have covered themselves legally. There are many legal places to get the videos, such as the artists' own websites, their record companies' websites, launch.com, mtv.com, bet.com, etc. I also pay for my downloaded songs, thank you very much.
