    Default Spermint Rhino lease?

    Hello,

I am a dancer in Albuquerque, NM where a Spearmint Rhino will be opening tomorrow night. I'm interested in trying it out but was a little put off when they asked me to sign a lease. I've signed papers in other clubs promising to follow rules of conduct, etc. but never a "lease".

The club advertises no fees or schedules but the lease states a minimum of three 8 hour sets a week. A missed set results in a $100 fine. When I asked the manager about it he said "This club won't have schedules, that's for our other clubs, don't worry about it".

The lease also states that there will be cameras and the recorded material may be used in advertising or on the Web. I'm used to cameras in the clubs but only for security. Again the manager said "Oh, we don't really do that, don't worry about it."

The manager's word means nothing against my name on a lease. My boyfriend suggested I could cross out what I don't agree to, initial it, and if they too will initial it I then could sign it. I don't want to be a pain in the ass dancer but I definitely don't want my image used on the web and I can only dance twice a week, not three 8 hour shifts. I want to get in on the new club money but I'm hesitant about signing a one year lease. Am I overreacting?

Has anyone here worked for Spearmint Rhino or signed a lease to work in a club?

If the manager says dont worry about it then why is it in the lease. I wouldnt sign the lease if there is anything you dont agree with.
My friend worked for SR in the UK. Over there most dancers pay the club a house fee to work and I remember they had pretty high house fees.

A lease is a binding document. All those verbal agreements should be put into the document so they can be seen by a third party (like a judge.)

I don't think I would sign anything like that anyway.

I mean, it is written for their benefit (though I am sure they will say it will "protect" you too.) Well, maybe you need to have your benefits more closely explained and WRITTEN into the contract.

Otherwise you can open your own club - oh that's right - the conservative christian right is in power. Welcome to getting "corporateer'ed."

Former Spearmint Rhino show girl here...

Yep... they all have leases.. basically indicating how much each lap dance is, how much they receive from the lap dance and the rules of no showing, etc... if you no show you are fined, or you might be asked to do a make up shift...

Its not a contract.. its a lease to lease space to entertain. your images will not be used on the web, unless you compete in corporate wide competitions. If you have questions call the corporate offices, their number is on the bottom of the lease. They do this with ALL dancers, basically stating that you are not being provided with ANYTHING other than stage space, and you are leasing the space from them.. meaning- house fee.

PM me if you have further questions, and I work in the legal field now, this is not something that is going to get yourself in trouble, its basically a formality.

Thanks for the advice. My club just dropped the house fees due to the impending competition so right now it's a better deal to just stay there. Hopefully business will keep up. I'll have an attorney look at the lease if I decide to switch. I just can't sign it otherwise. Though I'm sure they wouldn't pursue it, the lease is automatically renewed for 3 years unless written notice is given and technically a dancer could be fined $100 per all those missed sets if she decided to just bail out.

Where is Spearmint opening in Albuquerque? Did they buy out an existing club or open a new location?

Not to be a know it all, but
    Yes it is a contract.

Actually this document seems to qualify as several kinds of contracts. Employment contract. Liability limitation contract. Lease of space contract.

If you are signing a form and making a promise, or 'undertaking' (in legal talk), that's a contract.

It's on University Blvd. just south of the Big I. There was a club there called Eclipse that only lasted about 2 years. The location is not so great, it can be seen easily from the Interstate but it's hard to figure out how to get there. It just opened Thursday night.

You left out 'unconditional photo release' contract for all images taken by club cameras.

I ran into the same thing when the club I was at switched ownership. The GM wanted all the girls to sign an eight page contract (or something like that). I could not believe how many girls actually signed it without reading it. I took it home read it over, crossed out a few things I didn't agree with (my image being used for publicity) and I initilied all the changes, and made a copy for myself to keep and made the GM initial them before I signed the clubs copy of the contract. If what the manager says is legit you should not have a problem getting him to initial the clauses you don't agree to.
