    Default Will I ever see my $?

    Hi, I briefly had s job delivering newspapers. The jerk will NOT pay me for the time I worked. I contacted him twice by phone, called the paper co. (they said her is an "independent contractor" (as I was & can't make him do anything, altho the regional mgr. has contacted him asking him to pay me). I sent him a certified, notarized letter (w/a copy to the editor) this past week asking him to pay me. I have contacted the labor board, I have to re contact them to make sure they send me the forms. It take them months & months to even get to your case. I hadn't filled out any forms or anything when I was hired, so it sound pretty frickin' hopeless?

    Have you thought of taking him to small claims court? I'm certainly no lawyer, but it seems like that is where a dispute between two independent contractors should be settled.

    I guess I could try that. But, other than the letter I wrote to him saying he owes me, what proof could I produce saying I worked there? I can remember some of the route I did, it's in my area. I'm trying to see if the letter I wrote will produce any re$ults, this happened previously (w/another place) & it worked then. I guess I could contact Better Bus. Bureau, saying he's shi**y bus. person. Not sure if tha't do anything...

    Well, you can always get a notorized letter from the Regional Manager...if he knows that you were working for him...

    If you didn't punch a clock, and you didn't fill out any paperwork...there is really no proof that you did any work for him. Are there other people who can vouch that they saw you working for him??

    ^ Or perhaps other people who also got screwed over by him? I don't know how you'd find them, but you can bet they exist, and that would sure help make your case.

    Small claims court sounds like the best idea.

    You may want to take him to small claims court. i'm not sure how much they owe you, but I think it's only approx $35 to file a claim. I'm not 100% sure, but they may even have to pay if you win the case.

    Bunz,

    If you get nowhere with the labor Department you may want to consider the fact that newspaper A hates newspaper B, no mater who A and B are. You can tell the paper you delivered that unless they put pressure on their distributor to pay you, you will go to newspaper B with the story about how they let their person screw you. Do not say you want them to pay, or it might sound like extortion. Do not threaten to sue the paper as that is also extortion. Do not make it sound like you want them to do anything but the right thing for the right reason.

    Winning in small claims court is not hard, collecting the judgement is. 8/10 times the one being sued does not show up and just changes his bank accounts to make it hard to collect. You can also make it hard by picketing where you know they will be and call newspaper B to cover it. TV also hates newspaper A.

    If you do sue in small claims court also sue the paper since they cannot hide. Do not say to the paper that you will sue, if...

    My cousin went through a similar situation this summer. She got a paper route & decided it was not her things, so she tried to quit. The paper told her she owed a $150 penalty for reneging on a agreement to do the route. She ended up transferring the route to a friend so she didn't have to pay the fine, but my point is, the guy may be holdling onto your money as a penalty....he may claim you owed it to him.
    Good luck. This happens a lot with independent contractor situations...my friend R. was cheated on a construction job where the boss pulled the "No one can PROVE I owe you X amount." So R. stole his tools. LOL

    Well, thanks, all. I did send out the certified/notorized letter...& got $ within a few days! It wasn't exactly the amount I expected, but it was betther than nothing.
    I JUST HATE FREAKIN penny a** frickin' ppl that have shaft an honest person out of a few $.
    I'm quite sure he's done this b/4. Now, I MIGHT be dealing w/ a simiar situation w/another "employer" (small biz). I'm due $ this coming week, so I have to wait a few days, about mid-week I'll call, then send out another cert., notarized letter. Cripes! Note to self: DO NOT work for small biz. unless filling out paperwork, signed guarantee/& even then ?
