    so sorry to keep talking about this, but im sorry.. its just a really rough thing to go through.. i've never been in trouble with the law and im not quite sure what the whole process is.... but anyways, so my trial isn't until November 29th... i can not believe i have to sit and sweat and wait until then to see whats going to happen to me... what the hell is that???? well here in about ten ten days i'll know about driving privileges.... any advice from anyone on how to cope with all of this... i am on my last limb here.... help!

    Kam, That is a long time, but they make you wait, as long as you can drive in the mean time, you should be ok. They can;t suspend your license until you go to court, so you should be able to drive, unless this time is counting towards your license being suspended. I know it sucks, I have been through it, but its not the end of the world, and you will get through it. All you can do right now is wait, hopefully you will be able to drive, every state is different, so I can't really say what the laws are in your state. You should look it up on the interent, also if you have a lawyer things could be different. Keep your head up

    thanks logan!!! yeah my lawyer is iffy.. hes a good friend of my dad's and he just doesnt seem to be going the extra mile for me.. all these other people that i know got their driving privileges right away.. they didn't have to wait those thirty days.... i just don't get it.... i mean what about people that have to travel for their job.. what are they supposed to do?? just quit.... same with me and school.. i have a 45 minute commute... i mean thank god i know someone that i have been driving with to get up to school or else i'd be scrwed. yeah im counting down the days...

    I have not read about the particulars of your situation, but as a general rule I don't support giving someone back their license despite an offence just because they need it for work; the idea of suspending your license is to prevent you from repeating the offense before you've learned your lesson... or at least to justify upping the penalty should you reoffend (ie DUI while under suspension).

    For the same reason, I don't like the 'assigned risk pool' which is a type of driving insurance that is government-mandated for people who shouldn't be allowed within 10 feet of a steering wheel.

    Kam, just try to keep on your lawyer, they don't do something unless you push them. I know it sucks, I have been getting a ride w/ my mom to work! Sometimes I take the bus, my state doesn't have the occupational license, I wish it did, I have learned my lesson w/ the alcohol tx, I had to pee in a cup again tonite, but all my screens, it has been a month now, have come back negative . Hopefully you will be spared this! Good luck sweetie, I am here if you need me.

    If your lawyer is "iffy" ??? Please elaborate.. or do you mean that you aren't getting anywhere with him returning your calls. Did you pay a retainer? Did you explain to him that you wanted driving privies? I know, questions, but PM me and also- what state are you in?

    my lawyer just doesn't seem to be doing all he could for me.... i'm bascially just trusting him by letting him steer me in the right... i had a trial i was supposed to attend about two weeks ago, and he told me he had taken care of it and that i wouldn't need to be there... then i was supposed to have a phone conference with the judge on the phone??? and i didni't have to do that either..... all i know is that i have a trial on the 29th of november and that will determine what sentence i will get.... i am in the state of ohio....... i am just counting down the days until i can drive..... only ten more....... i just feel like a rat right now having to take city transportation to school and back..... dancing is on hold right now because theres no way i can manage doing that without getting my driving privileges back.... what to do what to do.. uhhhhhh.

    Telephone Conferences are standard practice and not all that uncommon at all. Sometimes a telephone conference will be done before the actual trial if the person being charge is a first time offender, but I have never heard of a telephone conference done in a DUI case, unless of course, the judge that has been assigned to your case has become overbooked and is unable to do a pre trial conference, which would make sense.

    *mind you though, that a DUI is a serious offense and carries, as you well know, hefty penalties, fines, etc*

    Has your attorney copied you in on any correspondence from the courts? Pleadings such as notice of hearings, notice of telphone conferences, notice of pre trial conference etc? If not, you need to get those..

    Yes, attorney's will go to court for you on your behalf, however, in your case, and since I am assuming that this is your first offense(?) it is always in your best interest to go as well... all of those things, hearings etc require a response from you, if you are not being represented, or a response from your attorney and your attorney should be cc'ing you on ALL court filings, etc.. If he isn't.. you need a new one.

    Check your state civil codes and procedures (you can do this online) or you can call your county clerk's office and obtain all information pertaining to your case- you will need to pay for the copies though..

    If you are just worried about what type of sentence you are going to receive, it all is going to depend on the statement you provide to the court, your blood alcohol content level, the manner in which you acted while being arrested, and if you caused damage to yourself, another person or property and whether or not you are a repeat offender. You will be more than likely asked to provide a statement to the court to explain your remorse and why you feel you should have your driving privledges reinstated.

    In my state first time offenders get a $500 fine, 30 days in jail and 200 hours of community service and 6 months probabtion. Usually, the 30 days in jail is suspended with a minimum of five days served which can be done on the weekends....

    Which then of course leads me to bring up the fact that once you are placed on probation, and if your driving privledges are reinstated with restrictions, you MUST adhere to everything that the court rules, or you will be stripped of your license, thrown in jail and then you'll not only have the original DUI charge to deal with but then a completely different charge of Probabtion Violation. (I dont' mean to scare you here, but I have seen this happen to a lot of people who just don't get the fact that they can't drive on non working hours if their license has been given back to them for the purpose of work driving only)... In any event, just be smart, follow the rules and whatever you get dealt, learn from it, get it over with and don't do it again!

    As for your attorney, you need to communicate with your attorney.. and if he's doing a shitty job, then you need to fire him and obtain new legal representation.. and in that case, you can contact your county's legal aid office for a referral.

    thanks!!! great advice..... you're a paralegal i take it??? yeah my attorney has been handling everything himself... he has sent me my papers and things for my court date.. i guess im just confused about the whole legal process.... i have never ever been in trouble like this before... i guess you could call me an amateur.. i don't mean to come off sounding really stupid... i really just don't know how all this works....

    One thing I've learned is that you never NOT attend a court date or conference. You do not necessarily need to talk (let the lawyer do the talking) but this way you KNOW what is going on and if you have any questions, you can ask them right then. Besides all of that, it makes you look INVOLVED. You'd be amazed at how many times judges give more lenient sentences to the people who dressed well, attended everything, and brought their parents along (if they are younger/living at home). It makes you appear that you care and that your parents are on top of the situation with you.

    But, yeah...you really need to talk with this lawyer. Are DUI's his specialty?

    the thing is i'm just doing everything i'm told to do... the lawyer is my dad's friend... and my dad is the one who will be paying for all of this.... so im kind of leaving it in their hands that i'm doing everything right....... i feel like im in the dark...... i just know that i have to sweat it out until nov 29th.... i've been kind of uncleaar about things too... i haven't exactly been charged with the dui...... i won't know until the 29th... i'm just hoping for the reckless op...... god remind me to never ever ever drive under the influence.... even if it was only a few drinks... a few drinks isn't worth the time and headaches.

    Geez... 1st time offense in Wi is $700 fine, I believe 6 months suspended driver's license, with occupational available, and 6-8 weeks (depending on county) driver's safety, which is one day a week for about 4 hours. I had to have personal counseling though, because of my admitted past drug use with my alcohol assessment officer.

    Anyway, don't stress yourself out too much about this, just learn from your past mistakes and don't let it ever happen again!

    yeah i'll try my best...... its just the worst thing about it is that my parents are the ones who are paying for my court costs and legal fees... and my car is in their name and they pay for insurance...... i just feel like such a fuck up.
