    Wow...that's all I can say about this story. It's just crazy!

    TORONTO (Reuters) - The Canadian province of Ontario plans to review a court decision that acquitted a man of sexual assault charges because he suffers from "sexsomnia" and was asleep at the time of the incident.

    The Office of the Attorney General, which oversees the province's prosecutions, said on Thursday it needs to research its options for an appeal because of the strange circumstances of the case.

    "This matter will be carefully considered to determine our next steps," said Brendan Crawley, a spokesman for the Attorney General.

    Jan Luedecke, 33, was acquitted of sexual assault charges on Tuesday because he said he was asleep during the attack.

    A sleep expert testified that Luedecke suffers from a disorder that causes sexsomnia -- involuntary sexual behavior during sleep -- which he had experienced before.

    The court heard that Luedecke and the female victim met at a party. She testified she fell asleep and woke up to find Luedecke having sex with her. She pushed him away and called the police.

    Luedecke confessed to police after he discovered was still wearing a condom and realized he had had sex.

    Canadian media reported that the victim left the courtroom in tears when the verdict was read, and said she would take the case to the highest court possible.

    The Crown has 30 days to present its appeal.

    This is real. I have it. I do and say things in my sleep that I have no memory of doing. I have never had full on sex with my wife while sleeping but have fingered her and said things to her and had no memory of it. It is to the point that if I were not married, I would not be able to sleep in the same bed with a woman I was not having sex with because I don't know what I would do.

    This is apparently not something they just concocted. In fact there has been a great deal of research done on it. You may have heard this sort of thing also referred to as 'sleepsex' or sexual behavior during sleep (SBS).

    I remember a similar case some years back where a man went out and attacked an elderly couple who lived next door while in his sleep, and much like the guy in this rape case, he didn't remember a thing upon waking up. Turned out he suffered from "night terrors". He was acquitted as well I believe.

    I beleave it. I've woken up coverd in mud, and I shouldn't have been. Horrible part was that I was sleeping nude, and I'm going to have to assume that I went out nude. I've also woken up outside, done my dishes, and given my partner a blow job. All while sleeping. I put special locks on my doors and windows so I can't get out side if I do it again.
    Since she woke up, and pushed him away, and from this article it appears he listend, who can say whos to blame?
    Rapers, yes they should be taken care of, but this guy cooperated w/police and all.
    Really it goes against the psychology of rape. Does this make the chick feel less violated, no.
    I say they should give him a lie detector test to feel his leval of memory. If he doesn't remember it, well he should still have some cociquence for his actions, after all, people are responsible for ice in their drive ways, if their dog bites some one/thing, even tree son property. So acountability for his actions is needed.

    he was so asleep that he had the common sense to wear a condom....? yeah right,,, a kick in the balls would have woke him up probably... to use violence you need a mind set .i can believe you can give sex during half sleep state of mind if u r in bed w yr wife /husband but use violence ,,,, that requires intention .

    If it matters, both parties in this incident were drinking prior to alleged activity, which murks the situation even further IMO.

    I read about this in the Toronto Sun the other day... I still have no clue what ot think about it ... it just seems... weird. I know sleepwalkers do a lot of shit they dont know they are doing(my mom used to be bad for this) but raping a woman.. I dunno..

    I agree that raping while sleeping is a way too weird behaviour AND should not be excused, even if it's during real sleep.
    Murdering while you sleep is still murder.

    But this post reminded me of some similar experience I've had:

    There was this g/f in particular who had these truly magnificent breasts I became in love with (apparently day and night)
    Almost every other night I slept with her, she awoke with me seriously fondling her breasts!

    At first she thought I was awake and could not believe it, but after some nights she became acustomed to forgive my unconscious, mischievous behaviour and awakened me with similar treatment.

    I was told by my parents once that when I was younger... I sleep walked to their room (they always had their door open whereas mine was closed)... stood in the door way.. they inquired as to what I was doing there... and I proceeded to strip out of my pyjamas (nude)...

    I agree that it is a real condition as alot of people some crazy shite whilst asleep. Just that he needs to have some repurcussions for his actions however he isn't, what I would consider, a true rapist. He didn't use violence to coerce her into sex and that is usually a trademark of rape.

    I wouldn't want to believe it, but I had a roommate in college who was a sleepwalker, and among his sleepwalking exploits, he...

    1-walked into the bedroom of my other roommate and his girlfriend in the middle of the night, took his pants down, and pissed on the floor in front of them. This was at the girlfriends parents' house.

    2-Climbed out of his window and on to the roof of the house he was living in at the time.

    3-On a different stayover at the girl's house in #1 above, he walked in to the girl's mom's bedroom and got into bed with her while he was naked and started sort of cuddling up to her.

    Sleepwalking is some freaky stuff. I wouldn't want to believe it if I was her, but after seeing this guy in action, I guess it's possible.
