    Default selling my photos

    I have recently been doing some modeling for a photographer who wanted shots of me doing nylon/foot fetish pictures. I have a huge inventory of my photos on CD now, and as he told me I may use the pics wherever I please, I'm looking to put a collection together to sell them. Where would you recommend a good place to start would be?

    He may have said you can use them wherever however he may have been meaning this is a "not for profit" fashion (ie for portfolios, avatars, etc). Are you doubly sure that you have full copyright of the photos?

    Once you have established you have full copyright of the photos.. pick the best ones (up to 5) and offer prints of each. Make sure you have a watermark on them or something (ie thumbnail size photo) when you publish them on the 'net so that there is an incentive for people to buy the prints.

    Exactly! Hun, you don't own anything. That is the purpose of TFP/CD. Yes, you are able to use the images for promotional use only, but you don't own them, so technically you shouldn't be attempting to sell these images TO ANYONE!!! Unless of course you want a lawsuit by your photographer

    Amen! That is what i thought i could do with a few very good photos taken by a photographer a time back...WRONG. They would have sued my ass off.

    Um, from what I understand, if you have NOT signed a release form, (thereby allowing the photographer full right over your photos, and releasing YOUR copyright rights) then, they are legally yours.
    If anyone feels this is incorrect, please state the legalities of owning the rights to pics.

    A contract given in words (verbally) is still a contract. Granted, if he didn't specifically state when he said "you can use the photos in whatever way you want" (or whatever he actually said to you) he is imply-ing that you can use them in whatever way you want. If he meant that statement in re: using them for not4profit ways then he should've said so or gotten you to sign something. That's the only way I can see you having copyright of those photos.

    Otherwise, take the safe road. Use them in a not4profit fashion (portfolio, avatars, etc).

    Um, NO...You still don't own ANYTHING! Try it is you like, but you will get sued. May not happen today, may not happen tomorrow, BUT when your photographer finds wind of you doing this there will be hell to pay.

    If you have no signed a model release then yes, you have not given the photographer rights to use the photos ONLINE. But, he can still use them for his portfolio. Just because you posed in front of a camera does not make the pictures yours. TFP/CD means you are paying for each others experience. So, even though you don't sign a release, all that means is that he NOR you can use the images online ANYWHERE!!!! Those images are still works of this photographers creative genius. <--So yea, he still owns them.

    Thanks you guys! I didn't really think about it that far ahead, but I sooooo don't want to get into trouble! A few bucks just aren't worth it...

    I was a photographer for several years. Unless the photographer signs it away, s/he is automatically the holder of the copyright. If you use the photos for profit, you will need a signed release from the photographer or you risk a lawsuit.

    Why not just tell the photographer that you'd like to sell some of the pics because he does such great work, ask him if he'd mind signing a copyright release because you respect his rights, and if he wants, you'll give him full credit for the shots because you'd like to see his name out there? Or something like that.

    What about if the photographer gets paid for the work he does? For ex. if I make an apt. w/ you and pay you for the photos and you give me the negatives, are they legally mine?

    ^^^^^ Only if that's spelled out in the contract. It usually isn't. For example, if you go to Olan Mills or the Sears portrait studio and have pictures taken, you cannot sell or copy those pictures. They aren't your intellectual property, they're the photographer's (or the company's).

    If the photographer is willing to give up the negatives though, s/he will most likely be willing to sign a release giving you full rights to their use. However, this isn't such an easy situation now that just about everyone shoots digital. Don't assume that you own the rights to anything! Get it in writing first.

    I always make the photographer sign over the rights to me .I have a form preprinted for this unless he is willing to pay me for the photos I am retaining the rights to them.

    Has anyone had any 'luck' with www.images4sale.com ?? I'm starting to acquire a nice 'portfolio' of photos that I do have copyright over (yes, a signed piece of paper states as such) and thus will be able to sell.... I came across this site and am wondering if anyone uses it to sell their photos ??

    Ok, so let me get this straight. I have to do a photo shoot within the next month or so (as soon as I choose a photographer) and I just want to make sure I don't mess this up. I have to get pictures taken for my promos (the 8x10s and 4x5s that I'm going to sell at clubs and online once I start featuring). So in order for me to be able to keep making more copies of the photos I get taken and sell them, I have to have the photographer sign a contract saying that I have all the rights to the pictures? Just want to make sure that I don't pay for a photo shoot that I can't even use the pictures from. I'm sure my agent knows how to do all this, but I just wanna get things straight.
    Take the road less traveled- just make sure you have a map.

    Yes, pretty much. But please be prepared to know that you will be paying a pretty penny for those images, if you want to own the exclusive rights to them.

    Or you could go the route I took and do TFT (time for time) or TFCD (time for CD not prints) with shared copyright of the images thus it only costs you (and the photographer) time instead of money for the photos (even some professional photographers will be open to it).

    Yes, she could...but she is trying to profit from these images. No photographer (any good one by the way) would share a TFP/CD copyright...NO ONE!!!

    Trust me, if she is trying to do some feature work, and selling those images, she's gonna have to pay. And if he is fool enough to get a shared copyright (which is rarity anyway) then you'll still be splitting the sales 50/50 with him

    I would figure it would be easier (and more personable) if she offered polariods of her with the person(s) for $x per polariod when featuring ??

    Granted, I do have two 'glamour' (full make-up and hair done by professionals) photos that I paid near $200 (AUD) in order to have full copyright/commercial rights. So yes, it will cost if she wants 'glamour' photos (where she has her make up and hair 'done' by professionals with a 'professional' photographer).

    At the same time, I have plenty of TFT/CD images which I can sell at my leisure that are quality enough (more along fetish lines: ass, leg, feet, hair shots).

    My original question about images4sale.com still stands unanswered. I'm naturally assuming no one on this site has dealt with this particular site. Would I be better to sell my images on ebanned (even tho' none are of a XXX nature - I do have nude however they are tasteful and only 'playboy' style where I do not show any pink)?

    Ok, ok you've broken me down. I have heard of the site GCG. My photographer was thinking about posting some images on there a while back. Last he told me is that it is not a profitable means to making money. There are so many photographers who are involved in stock photography. And the people who are posting their images on sites like this are in the thousands...it would just be really hard for someone to pick your image compared to tens of thousands of others.
