Havent had one but was scared as hell driving home last night... had 3 drinks between 7-2 at work... felt fine until I was halfway home... I am never drinking at work again... felt so stupid when I got home and realized how drunk I was... dumb dumb dumb me....

DWI if you get a good attorney and smart one and money can be turned into a wet and wreckless... my aunt blew a .08 and spent around $20k on atty to get it changed... but then again with a DWI/DUI its going to cost more than that in court costs, fines, fees, etc... I say chat to a few good attorneys and see what your options are.

I got one two weeks after by 18th birthday. (this was in Florida) I had to go to DUI school (cost about $250), had probation for six months, lost my liscense for a year (I refused the blow test), had either 20 or 40 community service hours, and a $500 fine.

If you have a good attorney they can usually help get it dropped to reckless driving. Good luck dear!

Blonde, my best friend got a DWI earlier this year in Charlotte (I'm in NC too). She got hers in Feb and kept getting it continued until the end of November. Basically, it was her 1st offence. I don't know what she blew but I know she's a heavy drinker and it was most likely way more than .08. She has driving priviledges for 1 year. 6am to 8pm monday through friday and she can only run household chores on weekends. She also had to complete 10 classes (at $40 a class) in 30 days, community service, and court costs. And AA meetings. But she didn't loose her license! Good luck.

thanks for the replies...yea I was pulled for doing a 58 in a 45...which isn't too terribly bad considering where I was pulled. I blew a .12, which isn't too bad nor too good, but the officer said I was really cooperative and I have never had anything on my record before this. I have a good attorney so I think I will prolly have to go to the DWI school or whatever and prolly get a curfew on my liscense...I hope it all goes ok...my court date is Jan 13th

I got one seven or eight years ago, license was suspended for six months, paid the fine, did community service, took the class, and since then I've been a good boy...

If you never get another one, it won't be a big deal. However, if you do....

This doesn't really help you now, but for future reference...if you get pulled over after having had enough to drink that you might blow over the limit, and your situation is such that your life won't fall apart if you can't drive for a while (aka, your job, school, daycare, whatever is somehow reachable without a car, even if it's a gigantic pain in the ass)...refuse to blow. You won't have a license for a year, but you also won't have an addition to your criminal record, have to pay for traffic school, court costs, and an attorney, and I don't think a civil revocation of your license affects your car insurance. Plus, if you get convicted, you'll probably lose your license (or have it severely restricted) anyway. If they get a reading over the legal limit, your attorney may be able to swing some kind of plea, but they can basically convict you out of hand if they feel like it...but without a reading (assuming you were stopped for a routine violation or checkpoint instead of an accident or something, and that you didn't completely screw up the sobriety tests...and even if you do, just act like you're really upset - probably won't be hard - and blame it on nerves) it generally isn't worth the effort to try for a conviction.

Try not to feel too bad about it...you could have gotten into an accident or something instead of just pulled over. And, if people try to make you feel bad about it, remember...we all know better than to drive drunk, but almost everyone I know has done it at one time or another even if they didn't get caught. Best of luck on your court date!

I've had a couple of attorneys tell me to always refuse the test but I don't know. WTF do you do if you lose your license for a year? I'd basically be fucked becuase I'd have a damn hard time working. It's not like I have someone to drive me around. Thank god it's never happened to me because I'd probably piss myself being nervous!

I think that advice is based on the fact that if you blow and you're over the limit, you're almost certainly going to lose your license anyway, plus all the expense and hassle of court and the addition of a DWI conviction to your record. But, your initial revocation is shorter if you do blow, and they use that to get you. The thing is, unless you were stopped because of an accident, or were driving so badly that it's basically guaranteed from what you were doing that you were shitfaced, its quite hard for them to get you for DWI. They can't force you to blow to get the reading, so they threaten you with losing your license for a year, which they know will be an almost impossible situation for most people...but then they have the reading, get the conviction, and you lose your license anyway .

Another thing I forgot in my earlier post in this thread...be as sweet, cooperative, and remorseful with the cops as you can. They decide what they're charging you with (usually there are multiple things they could charge based on a drunk-driving violation...they get to decide which to include, or if they want to charge you with every single thing available), and the information they put in their report can make you or break you when you get to court. Basically, they have a lot of discretion, and you want them feeling as charitable and sympathetic towards you as you can manage.

Edit: lol...sorry that I keep babbling on about this...I learned as much as I could on the topic when I had my own run in with the cops , and I really wish I had known more about it at the time...things would have gone much more smoothly.

I never had any DWI/DUI problems (not a big drinker, am a little lady) but I drove too fast for years & the CHP liked to remind me of this by pulling me over a lot. I so regret this. If I had hurt someone with my driving habits, I would have killed myself. It's not worth it- if you have the need for speed & wild life, buy a motorcycle. A automobile really can become a 1,000+ pound weapon.

Something to keep in mind for the next time...$20 in cab fare is a LOT cheaper than attorneys, court costs, suspended licenses, fines, community service time, and the time it takes to manage all of the above. Next time, just take a cab even if you are MARGINALLY intoxicated and save yourself a lot of trouble not to mention your life and the lives of others. I had a friend killed by a drunk driver when I was in high-school and tend to have little tolerence for this sort of thing. No offense BlondeLocks, but if you blew a .12, that's a LOT worse than "isn't too bad nor too good"...it's drunk. Plain and simple. In the range you were in, you fall into the following definition according to the CHP...

B.A.C. 1.2 - 1.5: Gross motor impairment and lack of physical control. Blurred vision and major loss of balance. Euphoria is reduced and dysphoria* is beginning to appear. Judgment and perception are severely impaired.

I'm sure you've learned your lesson, but please, we'd really like to see you be a long-time member here on SW rather than a fatality statistic. Please do yourself and those around you a favor and stop drinking at work or keep cab money close by.

Very true. But "I'll always take a cab" is easier said than done, because you rarely have a contingency plan for when the situations that lead to drunk driving come up. For example:

You drove, had a few more at the bar than you planned, and the area is such that it isn't a good idea to leave your car overnight.
You were driven in by a friend, you both drank, she won't leave her car, and you're less intoxicated than she is.
You lose track of what you're spending that night and don't have enough money for cab fare home.
You're at a bar by yourself, a couple guys stop being just annoying and start making you fear for your safety, and you don't feel comfortable waiting for a cab.

Obviously, driving while intoxicated isn't the best way to deal with any of these situations, but it's usually the "easiest", most direct way...and, when you've had a few, you generally go for the obvious solution .

I guess my point is, nobody goes out thinking, "I'm going to get drunk and then drive home, because I don't think its a dumb, dangerous thing to do". Like I said, we all know better. We just don't always plan ahead, and when unexpected things happen, we don't always deal with them in the smartest way.
