Angry Evil Bill Collector! This was so cruel!

I just had the worst fright of my life...

Ok so I get a call on my unlisted cell.

A woman's voice says hello, and she asks if I have a sister namd Elizabeth. I do, so I'm like, 'Yes, who are you?'.

So the woman goes 'your sister was in an accident. Can you give me her phone #?'

Well I started crying immediately and I say what happened, where is she? This lady says 'I can't tell you the details, but we need her home phone number."

So then I'm like, wait a second, this makes no sense. If she had an accident then why do they need to call her?

So I tell the lady I don't believe her, and she goes 'well if you don't give me her phone # then I won't tell you what happened in the accident'.

By this time I'm hysterical but I was on the computer anyway so I click anywho.com on my favorites list and quickly type in the phone # this lady called me from.
Sure enough, it's a collection agency. It was all a scam to get her number for some unpaid bills.

Can you imagine doing THAT for a job? Telling people their sister or whatever was in a wrek?

That's sick! I'm sure there is something you can do to have some sort of fine or something slapped on them. I would search around and see what the "rules" for bill collectors are, but to me, this "could" be considered a form of harassment. If you can't find any sort of govt thing to help, I'd be calling the collection agency and filing a complaint

    Wow, that is terrible.

My parents used to get a lot of calls from bill collectors; apparently some guy named Trey was using their number and running up debt. We never heard of Trey or met him, but the bill collectors didn't believe that. It got pretty funny - they started having sultry-voiced or giggly females call at all hours of the day or night asking for Trey. It lasted for months!

agreed with bunny....there are very specific laws governing debt collection! they are allowed to call relatives once to ask the whereabouts of a person owing a debt, but they cannot use bully tactics to do it, and you are under no obligation to give them any info. i hope you get lots of cash. and your sister too...they are probably violating left and right on this debt.

check out http://www.creditboards.com and http://www.artofcredit.com and there are other stories like yours, although none as bad as that.

Be sure to keep a log of all of these calls and maybe inform your cell company of what happening...especially if you are losing minutes because of this

Ditto to what Bunny & Xbloodydewdropx have suggested here. I'm no lawyer, so I don't know exactly how it works. But I think a lawyer can probably get punitive damages for you due to the "mental anguish" induced, considering what was done to you. And they can also probably be sued for "theft of services" for screwing with your cell#. Since I'm not a lawyer, this is not to be construed as legal advice, but these are two questions I'd be asking an attorney if I were in your current situation.

Wow.. Call the collection agency and file a complaint. That is the most horrible tactic used to get someone's number that I've ever heard.

I actually suggest what Bunny did.

That's fucked up on so many levels.

Yes, what she did is illegal.

Phone advice for the 21st century -

Don't ever, ever speak to someone on the phone who is unknown to you.

If you receive a call from an unknown number/person, don't pick up, let them leave a message.

If you do end up speaking to a person unknown to you, ask "Who is calling?". If they only give a name, ask for the name of the company they represent. If they refuse to identify themselves or their company, hang up.

If they ask for you or someone you know by name, offer to take a message.

Never, ever give any information over the phone to a person unknown to you.

i would definately get in touch with a lawyer. That lady had no right to tell you that your sister was in an accident.

i'd be furious if that happened to me

file a complaint with the federal trade commission www.ftc.gov there is a form on the site, what that bill collector did is illegal & the ftc is the agency that fines them, you don't need a lawyer. also some cell phones will allow you to record the conversation , it helps in some cases.
here is a page that says what they can & cannot do http://www.ftc.gov/bcp/conline/pubs/credit/fdc.htm

People, we do not have to jam up the courts with lawsuits every time someone is an asshole. File a complaint and be glad your sister's really okay (although it sounds like she's in some bad financial trouble). Nobody was hurt. A lawsuit is not necessary.

Well I tried to call the agency to make a complaint.

I first asked to speak with a manager, and the receptionist (whoever answered the phone) goes I'm the manager, how can I help you?

I tried to say I was getting these harassing calls, but she started YELLING at me that there is money owing and she yells a bit more that I couldn't understand because then I was yelling too, lol.

This is so freaky. It's a good thing my car is in storage otherwise I'd go down there and ... um...(tries to think of what damage I'm capable of)... I'd throw throw coffee on her or something. lol Well for now just in my dreams I suppose.

Lets see if they call me tomorow. The saga continues.

^ It IS harassment if they are repeatedly calling you and you are not the debtor. I would also question how they got your cell phone number.

Call the FTC and file a formal complaint. Get a copy of all of your cell phone bills and highlight all the times that the collection agency called you. Call them back one last time and tell them calmly. I have just filed a formal complaint with the FTC because you are not only calling me and using minutes on my cell phone, but I am not the debtor. I am not the co-signer. You have no legal grounds in which to keep attempting to contact me. And then hang up. That's it. If they keep calling you (only if they're THAT stupid) call the police and file a police report for harassment. THAT will shut them up it nothing else.

    BTW...are you in the states?

    Wow, thats crappy.
How did they get your cell #?
I've heard of bill collectors calling peoples parents house and pretending to be old friends, but nothing like that. If they call you again tomorrow, that is harassment, they can only call relatives one time, and if the relative says do not call again, their not aloud.
I think that bill collectors who harass should be taken to court, or at least have complaints filed against the company. Smart of you to look them up
Good luck, and don't pay your sisters bill or else you will be permanently marked as the one to call and harass when she doesn't follow through.

Venus I'm in Canada right now but the call came from 212 area code which makes sense because my sis is at NYU for school. So your advice is well taken about the FTC, and if I call the cops it will be a Manhattan station-house I guess?

Susie - you hit the nail right on the head! I did that for a friend once and next thing you know everybody started calling me about his debts.

But my sis is not too irresponsible, I'm sure the bill isn't more than a few hundred. The reality is that I love her and I have extra $$ now (more than she), I probabally would have paid it on her behalf with my visa this afternoon if the dumb bill collector didn't try to give me a heart attack first.

No, I believe that you would have to contact your local authorities first. They'll file the complaint and then the Manhattan police will take it from there. Be sure to have copies of your phone bill showing how many times they've called you. You may not be in the US, but that company is bound by US laws. I am sure that Canada has some kind of rules regarding debt collection, as well. Look into that. It may be very possible that this company violated, not just US laws, but also Canadian law...which would put them in a shit load of trouble.

Susie - you hit the nail right on the head! I did that for a friend once and next thing you know everybody started calling me about his debts.
Next time, don't pay the bills in your name. Pay them with a money order and a return address of the debtor. Otherwise, they will call you.

You should seriously look into how they got your unlisted phone number. Check your credit as well. I hate to be the one to say it, but I hope that your sister didn't use some of your information to get the loan...or that she didn't forge your name as the co-signer...

I agree with Bunny. There is probably a violation or two of the Fair Credit Reporting Act. I also agree with Yekhefah in that it may not be worth the time, and you should just be thankful your sister is okay.

I had a case of ID theft a few years ago and get calls from "attorneys" attempting to collect on some forged checks and credit purchases, but I had more fun from some idiot who kept calling for someone at my number. I didn't know the person they were asking about and, being credit collectors, they were rude. I decided to have some fun. I attempted to have phone sex with the women collectors who called.

They'd give me their spiel, and I'd wait a moment then say "You sound hot when you're angry! What are you wearing tonight?"

One night the woman who called hung up. About one minute later, her boss called and said "You want to run that crap by me , Pal?"

I waited a moment then said "You sound hot when you're angry! What are you wearing tonight?"

    He hung up.

Finally, they did the unforgivable. They called me during a Cowboys-49ers NFC Championship game in the 3rd Quarter. That did it. I put them on the speakerphone so my friends could hear....

Them: "I'd like to speak to [Whomever]"
    Me: "He died"
    Them: "Who is this?"
    Me: "His brother"
Them: "You don't seem to upset"
    Me: "I never liked 'im"
Them: "He owes my client $8000. What are we going to do about it?"
Me: "I suggest you get a shovel, dig his ass up, and take it up with him."

I hung up. They never called back.

I hate collecters. I worked as one for a while. I lasted two weeks.
My latest conspiracy theory: I am convinced that Dick Cheney is, in reality, Elmer Fudd.

Well, they found an OUT OF COUNTRY cell phone number. What are the odds of that? Someone gave out her info...that's all I'm saying. Someone had some more personal information to be able to plug it in and come up with an unlisted cell phone number. BTW...you can refuse to have your cell phone number in listings...

I agree that you shouldn't run and sue at the drop of a hat but I had creditors that were literally calling me at my job and in my car and making me cry and also that called my mom and were downright ugly to her. I had an attorney who was going to file suit on my behalf because what they were doing was WRONG but I filed bankruptcy and couldn't continue with the suit. There's nothing that wakes somebody up like suing them. What they need is to get sued and have attention brought to them so that they will stop their abusive collection tactics.
