    Default Supposed to get something in the mail for taxes?

    Hi, I'm yet another newbie who will be filing taxes for the first time for dancing. I got forms in the mail from former employers and from school (grant money) but I have yet to get something in the mail regarding my income from dancing. Am I supposed to recieve something in the mail? I had more than one employer in the past year, just started dancing at the end of 2005, and I have to report grant money I recieved from school so I will be going to a CPA for my taxes this year. I am in the state of Nevada, in case that helps. Should I contact the Department of Taxation to ask?

    Sorry it's long-winded basically my question is: in Nevada are you supposed to recieve a form in the mail regarding your income from dancing for filing your taxes?

    Unless you filled out paperwork and are in fact an EMPLOYEE of the club, then no, you don't get a W-2. A majority of dancers are not employees, they are independent contractors, so they get no W-2.

    You should get a 1099 from the club as an independent contractor.

    tassle, what the chuckle refers to is this ...

    99.9% of dancers work as self-employed independent contractors (the only ones who are considered to be 'employees' and not 'independent contractors' receive an actual paycheck from the club with taxes withheld)

    While IRS rules arguably require that clubs with independent contractors working on their premisis issue 1099-MISC forms at the end of the year, 90% of clubs do not actually do so - and even if they do, the amount listed on the 1099-MISC form only includes the amount of money paid to the dancer by the club (example credit card charges processed by the club) and does not include any amounts paid to the dancer directly by club customers (which the dancer is expected to account for herself).

    By IRS rules, independent contractors must keep track of their own incomes and their own expenses, independent contractors must make estimated tax payments to the IRS every three months, and independent contractors must file a long form 1040 tax return with Schedule C (profit or loss from a business) and Schedule SE (self-employment tax) by April 15th.

    Sorry for my ignorance! So... I guess I shouldn't be expecting any forms at all... not even from the club I work at? Thanks for the info and the help!

    I never received anything in the 3 years I lived and danced in Nevada. Not one club issued anything. I never had to have the business license though. So I'm not sure how having that license now in NV will affect things. Still you will have to calculate your own earnings from dancing. Don't forget to save your receipts and/or estimate what you spent on all things you use for work. Costumes, make-up, hair care, etc......lots of deductions as a independent contractor.

    Melonie- I've heard otherwise. Does what you say apply to the state of Nevada as well? Isn't every state different?

    well the difference with the state of Nevada, if there is one, probably has to do with the fact that every dancer is required to register herself as a business by obtaining a business license.

    It is probably true that most clubs still don't do 1099's but the number is proabaly closer to half these days compared to a few years ago and considering that 10 years ago or so it was unheard of and had you asked most any dancer back then they would have told you that this was something that would "never happen" but it has and the number will continue to grow until only the smallest local hole in the wall clubs that doesn't take plastic, that by the way the dancers at don't make much money won't do it.

    Why because club owners have at last started to figure out that they can right off a huge part of there profits by shifting it to an "expense" paid out to the dancers.

    An example: A club makes after paying the rent/mortage, utilities, drinks and other expenses 10 million a year, this club has 50 dancers more or less through the entire year at the end of the year they decide to send each of them a 1099 for 50K (1000 dollars a week) this adds up the 2.5 million they can now take off the top and pay taxes on 7.5 million a tax saving of around a million depending on the total tax rate for where they are.

    Yes the dancers will be pissed about this especailly if the maybe didn't make quite 50 grand but it would be on them to prove it and being paid in cash as is typical how would they?

    I assume that because it would be such a book keeping nightmare to keep accurate records of what they paid out to each girl every night that they would decide to just go with some pulled out of the air figure IE 10, 25 or maybe 50K a year that works for their taxes.

    Like I said the girls would have to prove they didn't make that much, if they didn't and for every one that didn't there will be one that did and one that made more and will "swear to it"

    I dont think so. They cant just pull a number out of their a** and claim thats what we made. There has to be some proof of it. They have to have bookkeeping records prooving it. If not then Id contact the IRS who would contact them and want to see where these numbers came from. I seriously doubt this would ever happen. Not to mention the club would get into a lot of trouble from it.

    Audrey, you're correct. There have to be corresponding entries in the club's books showing customer payments on the receipts side (i.e. club's cash register sales of private dance tickets, VIP room 'rentals', credit card cash advances, funny money) and payouts to dancers on the expense side (nightly percentage of private dances and VIP's done by each dancer, cashed in funny money, and customer credit card tip cash-ins).

    Thus even though these club payouts to dancers may have taken place in cash over the bar at the end of the night, the club's accountant does have everything necessary to total up annual amounts and issue a 1099 to each dancer for these particular types of dancer income at least. By the same token, even if the club doesn't issue 1099's, if the IRS were to have reason to look at the club's books those same nightly private dance logs, VIP room logs, customer credit card cash advance receipts etc. would be readily available for the IRS to use in 'estimating' actual annual dancer incomes.

    Of course I won't even go near a discussion of the 'accuracy' with which club books can be kept (see Scores Owner Indibtments thread in the Club Chat section).

    That is sort of what I was alluding to, the "accuracy factor" yes they will have books, possibly accurate and quite possibly made up at the same time they issue the 1099's to back up that number that they "pick out of the air" then like I said it's on the dancer to prove she didn't make that much and how can she do that? Especially when there are the girls agreeing that "yep that's what I made, because they did or maybe they made more.
