    Default Still no W-2

    I worked at a retirement home for 3 years, and I left last year (June '05). In December, I realized that they have the wrong address on file for me (I moved while working there), so I called in early January '06 (somewhere around the 5th) and asked if they could either hold my W-2 for me to pick up (as they always do) or if they could change the address it was being sent to.

    Well, supposedly, the address change was put in, but I never got the W-2. I called my old supervisor back, and she says that she put in the address change. She gave me a woman's # in the corporate office to speak to. I called that woman and she said that the address change was never put in and the W-2 was sent to my old address. I gave her my new address and asked that another W-2 be sent there. It's been two weeks, and I still haven't gotten it.

    What should I do now? Is there anyway that I can complain to the IRS or something? I haven't filed anything b/c I was waiting for that W-2. Should I just take it as a loss and file without that info?

    They are obligated to get you this I believe (I am sure someone can correct me if I am wrong.) Have them FAX it to you (if you have a fax machine!) Or you can make the daily call for it and they will get it to you just to get you off their back.

    If the daily call does not work, try 2 or 3 times a day.

    Yes, they have to get this info to you. You can always tell them that you'll have no choice but to log a complaint of non-compliance with the IRS. They should have gotten the old one back (the PO should have sent it back). They can re-print another one and send it...they can fax it to you...they can print it and hold it...there is no excuse for them not getting it to you...especially after you called.

    If you do not have the information and you need to file...you can always use your last paycheck (you DID keep that, right?). If something changed that didn't make it onto your last paycheck...you can always file an amended return with the proper information on it later.

    Here are more ideas.

    Did you file a timely change of address with the USPS c/o postmaster at your old PO's zipcode? Call that office and make a complaint. Maybe they're holding it, or it went to the old address. If it went there, it could be in the mailbox or the resident is holding onto it or they threw it away.
    I loved going to strip clubs; I actually made some friends there. Now things are different for the clubs and for me. As a result I am not as happy.

    Customers are not entitled to grope, disrespect, or rob strippers. This is their job, not their hobby, and they all need income. Clubs are not just some erotic show for guys to view while drinking.

    The problem here is that, even though your former employer is at fault for not providing your 2005 W2, YOU are still required to file your tax return by April 15th, YOU will still be audited if the amount of income you report via guesswork varies from the amount of income officially reported on that W2 (the IRS certainly received a copy even if you didn't), and YOU will wind up paying additional taxes plus penalties and interest .

    The company is not at fault. The law required them to file with the IRS by January 31st. They mailed you your W-2 to your wrong address because that was what they had on file at the time they mailed it. The person living there should have marked it as you no longer living at that address and put it back in the mail box. The Post Office would have returned it to the sender.



    The company cannot legally refuse to provide you with another copy of your W-2. They may charge you a fee for their cost having to reprint it; most companies will not charge you on a first reprint. Call up their offices and ask them their process for making a request for a copy W-2, usually they will tell you if there is a charge for reprinting. Then, send them a certified letter, with return receipt requested, requesting a copy W-2, be sure to include the following information:



    Your name

    Your employee number (SSN)

    The year requested for

    Your correct mailing address or how to be notified if to be picked up





    Sign, date, and photocopy the letter. Keep the photocopy of the letter with your copy of the certification and attach the return receipt when it arrives. If you do not receive your copy W-2 in 30 days call the company back and let them know you still do not have it. If you do not have it at 60 days write them another certified letter stating you do not have it. At 90 days I would contact the IRS.

    You are required to pay your taxes by April 17, 2006. You can request an automatic four month extension of time to file by filing Form 4868 on or before April 17, 2006.

    That move happened a few years ago. The resident probably threw it away

    Or returned it to the PO whoich no longer has your Change of Address form available. So still check with that PO.

    I'd just keep calling the company you worked for if you don't get it. How big are they? I used to work in the accounting department at a couple of pretty large companies and we got numerous requests for W-2's. Sometimes my boss's inbox on his voicemail would litterally fill up with W-2 requests. It's possible that someone is just very busy trying to keep up with them and it's taking a while but still keep bugging them so you get it.

    Update: It came in the mail today! Woot, Woot! Thanks for all your help everyone. I called and left a zillion messages.

    Now this is where it gets interesting; filing the taxes...
