    Default Melonie And Other Tax Experts.......

    OK,I recently found out that my business owner ex-boyfriend has not been reporting his employees' taxes and has not been paying/reporting all of his own.His employees did a walk-out and never went back to work for him.I ran into his former head mechanic the other week and he told me he has proof the *sshat never reported the taxes and cost him and his wife several thousand dollars because they couldn't file jointly this year.Is there any way we can drop a dime on him and open an IRS investigation????????????

    I'm not being vindictive.This guy has screwed many people over with no repercussions.He needs to pay for what he's done.Simple.

    First of all I'm not a tax expert, or an expert 'anything' ... just an amateur who has learned many lessons via the 'school of hard knocks' ! At any rate ...

    I'm not exactly sure what you're trying to tell us in regard to your BF's alleged failure to 'report' the incomes of his 'employees'. Like exotic dancing, a fundamental point which defines the legal tax compliance requirements for a business owner is whether or not the people working for/at that business are truly considered to be 'employees'. Thus if your BF (who I assume runs an auto repair business ?) treats his mechanics as independent contractors, then your BF theoretically has no legal obligation to report the incomes of those mechanics or to withhold income tax on their behalf. On the other hand, if your BF treats his mechanics as employees, then a myriad of legal requirements exist in regard to employee income reporting, tax withholding, workmen's comp and unemployment coverage, etc.

    Thus if you're telling us that your BF ostensibly treated his mechanics as 'employees', withheld income taxes from their paychecks, but then deliberately failed to forward the withheld employee tax money to the IRS, this has 'felony' written all over it. Nobody will need to blow the whistle, because as soon as 'employee' tax returns start being entered into the IRS computers listing your BF's business as the 'employer', and as soon as a cross-check against tax withholding payments received from your BF's business shows a huge mismatch vs the 'employee' tax returns, the IRS will take action themselves.

    But if you're telling us that your BF's supposed 'employees' have just discovered that they have been treated as independent contractors, that they were actually required to send in their own estimated tax money and report their own incomes but didn't do so, and that they are now all pissed off to discover that they owe many thousands of dollars in income taxes, technically at least this is not a problem that can automatically be blamed on your BF's business.

    Mel,he's an EX-boyfriend.I'm not with him anymore.Thank God.But yes,he treats his employees (or the ones he had) like employees and not independent contractors.I spoke to the head mechanic and he said he has gotten the proper paperwork and it going to fill it out and return to the IRS.Yes,this is a felony.He has been doing this off and on for years and nobody has had the balls to do anything about it until now.I hope he goes to jail.

    A couple of comments:

    1) You may certainly contact the local state employment department and/or the IRS local district office by writing - them - even anonymously by indicating who he is; what company, its location, a phone number, and the understanding of the facts.

    Employment departments might be more responsive (at least in California)

    2) The question appears to have multiple parts.

    a) - were the mechanics indepdent contractors and just are now looking to get out of what was a good deal at the time. Commentary - under most repair shops - it is employee/employer relationship as the IC test generally fails - this leads to the requirement to have withholdings and for the employer to pay employer taxes and provide a form W-2

    b) If in fact they were treated as employees and there were withholdings on paychecks - then the challenge is that the ex-BF hasn't paid the employer taxes but the good news is that the employees receive credit for them if they have either a W2 or can demonstrate a substitute for a W2 (use last paycheck stub and copy of same for establishing the substitute form, a good professional can assist here) - if this is the case, then the IRS will track your ex-BF down within a year or so as there will be requests for refunds of taxes never paid.

    c) - Even better then having you "turn" him in, would be for a former employee to do it as they have personal standing in the matter.

    I reported a former employer to the IRS. Sound shitty but they wouldn't give me my last paycheck and really made me mad. I was a broke ass college student and needed my money. Then I found out that even though they SAID I was an independent contractor the employees they had should not have been but in fact should have been employee status. So I just called and reported them and the guy at the IRS said that yes, they should have been paying taxes on us and witholding and that I should have reported him. I have no idea what ever became of it but you can call and report someone to the IRS.
