    Default The IRS Form and Retalitory action

    OK some of you have had some questions... If I fill out this form can I be fired..

    2 things could happen

    1. The IRS declares you a employee and there for you can not be fired without cause If they fire you for filling out the form the employer is liable in addtion for Unemployment and back pay a fine from the IRS for retalitory action and civil penaltys..

    2 The IRS declares you a independet contrater and you meet the standerd of such and your employer terminates the relationship

    3. Since many strip clubs have mob conections expecilay in Tampa they do a Sopranos on you

    Therefore I recomend that you do the following---Fill out the form towards the end of stint danicng at that particular club and get the back wages owed to you and move on to the next club

    actually there are many other options - for example ...

    If you are declared an 'employee' then the club will provide you with an hourly minimum wage paycheck, plus unemployment and workmen's comp coverage as required by law. However, the club can also require you to turn over 100% of your private dance / VIP room money to the club, based on the principle that an employer 'owns' the fruits of the labor of its employees (however you get to keep 100% of your stage tips). The club can also require that you work scheduled shifts with a minimum/maximum number of hours per day/week (typically noon to 8 on mon, tue, and wed for a maximum of 24 hours per week). If you're willing to keep working as an employee under such terms, the club will not fire you.
