Default House Parties and Drunk Guests

Yesterday Canada's Supreme Court ruled in a unanymous 7-0 decision that

"Private citizens who throw social parties are not the same as commercial barkeeps and are not legally liable for the actions of irresponsible guests.".

Here's the link (I think you have to be registered to view):

One person was killed by a DUI driver. Another 18 year-old woman was left a parapalegic.

I'm undecided about the wisdom of this decision.

What do all of you think? Is it good or bad, and what do you think the effects will be??

I think if you have a party, you are responsible for the guests that are in your house. You need to set ground rules that everyone must abide by and enforce them. I would not allow anyone to drive drunk from my home, nor would I invite guests that would cause trouble. My man used to have house parties all the time, and everyone would stay overnight. He only had one person one time cause any real trouble, because he will only be friends with the best morally. This jerk someone invited tried to rape his friend and he put him through a wall. I still get a big laugh off of that one.

The drinker should be held accountable for his/her own actions. That's part of being an adult. The host of a party shouldn't have to play babysitter.

    ^ Agreed.

I feel that it is the same way in a bar/restaurant. Holding the bartender accountable for the drinker's inability to say "no more" is foolish and taking the responsibility off the responsible party.

very true. i had a friend living in Ohio have an underage drinker in his bar, who drove home drunk and killed someone. Last I spoke to him, it was under investigation but coming back on him, which is so stupid, thats on the doorman for letting him in more than the bartender. But whatever, people will always be stupid.

If a patron drinks like fish and gets in a cab it's OK, if they get behind the wheel, that's their fault! How can the bartender know if the patron says they're taking a cab? It's crazy to expect servers and bartenders to be mind readers.

It's also much harder to control at a private party, especially if as is usually the case, the host is seriously partying as well.

Who hires security for a party, besides the rich and famous?

Also you have the unpredictable nature of a party's guests. They could drink before or after going to the party, or sneak one in the backyard even if you cut them off.

This story is very tragic, but what it illustrates more than anything is the relative severity of the incapacitating affects of alcohol, compared to illegal drugs like marijuana--not that I want people driving after 6 hits off a bong, mind you. The guy that almost killed me when he hit me head on (I was on a motorcycle) a few years ago was drunk as a skunk, and had 3 prior leaving the scenes and many more DWIs.

Far, far more deaths are caused by drinking drivers, than people who got high first--as abhorrent as either may be. Alcohol is a very dangerous and harmful controlled substance. To put people in jail for having or selling small amounts of weed is absurd, when you have the kind of problems originating from alcohol abuse, which is laughed off until someone gets killed.

I never thought about it that way. I guess it's criminalized so alcohol distillers don't have competition.

Why should the actions of a drunk person be someone else's responcibility?
Are we so stupid that we have to have the government tell us what to do in all situations?

Yes, it is sad that people die because of alcohol abuse. But people also die because they eat junk food. What's next? Will McDonald's will have to determine if their customer is healthy enough to order a cheeseburger? I could just see it now... "I'm sorry ma'am, but you look like you've had enough. Why not try a diet coke and a salad instead?"

Paris, that would be funnier if I weren't so sure someone might actually try it.

Too many people want to blame others for their mistakes, especially if they can get money out of it!
