You call or e--mail your card company (Visa, MC etc.) and dispute it. It's against the policy between the card company and the merchant for the merchant to tack on a surcharge specifically for using a credit or debit card. When you dispute it the will issue a chargeback and more often than not will take the surcharge AND the charge for the item or service off. This is an example of big business getting in the way of those who pay with cash hoping to save a few bucks.





Before everyone thinks they are going to get stuff for free, this issue is only true in some states and not others. In Nevada, for example, it's legal for companies to do this where in California it's not. My bet is that most companies already know this and only issue the surcharge in the states where they know they can get away with it.

I didn't know it was something you could complain about. I was really pissed because I bought something at Taco Bell one day and didn't even realize they add on $1 until it was too late. I mean wtf? The food was like $7 or something and they add $1. I just haven't used my debit card at TB again.





It's totally illegal in Florida. Call your credit company and tell them what happened. Lunch will be on Taco Bell today!![]()

But before we all go making complaints, it should be pointed out that credit /debit card processing costs these merchants money regardless of what state they're in, but they can't afford to go without having this service, so like any other expense they have to pass that cost onto their customers regardless of how they pay.
If you're in a state where these surcharges are illegal, all it means is that your taco supreme might just cost you another 10 cents, and that's totally legal.
Also, some businesses cleverly get around these surcharge laws by using the "cash discount" loophole.
