    Default Legal Question ?

    Can an employer give you a no re-hire status if you decide to go work for the main competitor even if you give a two week advance notice ? They told us this at my current job and I was a bit surprised wasn't sure if that was legal .The competition is building a new store in town and mngmt is telling us this information .

    At my previous job, anyone that quit was given a no re-hire status. They didn't always stick to it, but there had to be a very good reason to re-hire.

    Then again, I live in Utah, which is a right-to-work state, employers and employees can pretty much do what they want.

    Corporations can do anything they fucking want. Hell - they can tell ya to piss in a cup for their pleasure too! Imagine that!

    In Arizona, employers can fire you whenever they want without reason and can freely discriminate when hiring.

    Come on now, don't always blame the big, bad old corporations for everything...

    The way I look at it, if you decide to leave your employer to work for the competition, you're leaving for good.

    In this case, why would you be worried about re-hiring? Do you already know it's gonna suck over there and that you will need to come back? If that's the case, just stay put and avoid the whole mess!

    If you want to switch jobs and then switch back, just to help your salary, then I'd kick you to the curb for doing that too! If you want a raise, come on out and ask. Then justify it when asked why you think you deserve one. Hey, you may not get it, but at least you stood up and asked, instead of playing games.

    Of course, what you do for that company has great influence on how you will be treated.

    If you're a customer service rep. in a call center, then you're equivalent to about 5,000 other people that apply for that job on a yearly basis. In this case, you're not going to get much of anything, and that includes being re-hired.

    Now if you are a 20-year veteran of IT and are specialized in say Telecom, you get different treatment. In this case, you are not easily replaced, if you can be replaced at all. If they need you, policy goes out the window!

    Hey thanks I guess they can do what they want . I am actually happy at my present job I just don't agree with mngmt when they make remarks like that to their empoyees I think its uncalled for . No one should stand in your way if you want to better yourself and provide a better lifestyle for your family . When I worked for Casinos I watched people leave and work for the competition all the time then a few years later they would come back .

    Kinda. Yes, they can say that.....they can say "if you work for us, then you cannot work for our compeditor even if you quit for 6 months" or whatever. BUT....based on previous case-law, that doesn't hold up in court. Basically, NO ONE can hold you back from pursuing or gaining in your career. Unfortunately, it could take legal action, but there is legal precedent.
