    One of the clubs I work at is a peepshow owned by Deja Vu. I make my tips, and I make a percentage of the shows and I make minimum wage. I've been working there for a year now. Well, I guess they messed up my social security number and I haven't gotten a W2 form yet. (I've since corrected them) Yes, i've been asking him again and again, yes I've gotten an extension... I've even stopped by corportate offices to see if THEY could do anything... But, I only got as far as the secretary before she said the manager should be taking care of that and picked up the phone to call him. I told her "No, no, dont' call him!" and that I'd deal with it myself. So, I ask him again the next time I work and he finally tells me that *I*, yes *I* need a $2.50 money order for bookkeeping to get another W2.

    Now, I'm not going to make a fuss over a couple bucks... we all know how clubs treat dancers... even "employee's" that are dancers... But I really feel like someone's passing the buck here... Anyone know what might be going on behind the scenes? I'm clueless. I'm SURE this has to be illegal.

    I don't think that they can charge you for giving you a W2. But, I have to ask...if they had your social security number wrong all this time...how does that affect your taxes? I'd love to hear about that from Melonie and/or Dan.

    I actually got something from the IRS about it... but I never replied since it was a week after I caught it and had it fixed.

    On the very minor matter of charging a fee for a 'replacement' W2, they probably can charge for that legally and it's certainly not worth arguing over.

    One would like to think that the 'late' W2 was due to a simple error in Deja Vu's accounting dept listing your social security number incorrectly. I'm not sure I understand your comment about receiving a letter from the IRS ... I would assume this means that Deja Vu sent a copy of your W2 to the IRS but not to you ? At any rate, the very fact that you received an IRS letter means that you are already on IRS radar ... meaning that you should make every effort to do whatever the IRS expects (like getting a duplicate W2 and filing an amended tax return ?) in a timely manner.

    However, it is not totally impossible that some of the developments of the past couple of years i.e. the California 'Employee Dancer' law, the class action lawsuit against Deja Vu Corp, the media publicity, and the resulting settlement between SF Deja Vu and the Cal Franchise Tax Board, the California 'bounty hunter' law authorizing 'private' tax investigators etc. has set some behind the scenes investigations and/or 'after the fact' accounting changes in motion.

    If so, this could explain why W2's were not sent out. If this was the case, however, odds are that ALL of the dancers at the Deja Vu club you referred to would not have received correct and timely W2's either. If this is the case then you need to be extremely careful that your own tax return numbers jive with the club's accounting numbers. Here I'm referring to the 'catch 22' situation of IRS law requiring that 'employers' document and report ALL employee income including tips and moneys paid directly from customer to dancer, and not just certain portions of employee income that the club has direct involvement in like hourly wage and private dance/show percentages.

    Complying with this law of course means that the dancer must report her tip and customer direct payment to the club on a regular basis and turn over the tip and direct payment money to the club, which in turn means that the club must report this as additional income plus withhold taxes plus pay SSI, medicare, state comp and unemployment insurance payments as a percentage of each dancers' total earnings, and add the after-tax amount to the dancer's employee paycheck. If this has not been happening, then technically it is the dancer and not the club who is in violation of IRS law for failure to properly report tip and direct customer payment income to the club.

    From what I've heard, everyone else has received their w2's... and the club only reports the part it pays us (the minimum wage and the percentage of dances). Well, it's nice to know they're not just raping me. I gave the letter I recieived from the IRS to my accountant. But, it basically said that my SS# was incorrect and it was probably from error.

    well, hopefully, the issue of where tips and direct payment income did or did not get reported won't be scrutinized too closely !
