    are we our own contractors?

    Ok, so I have been dancing for less than a year. The first club was a rat hole, but I BANKED$$$ there. The building was moldy and the girls were all getting pneumonia, I lucked out with bronchitis and acute athsma. Well, my question is.. I left because I could not keep getting sick and they would not give me time off. When I "Called in sick" I had to bring a doctors note in order to to pay tip out on the day I missed. IS THAT NORMAL? PAYING TIP OUT FOR NOT BEING THERE? also, I have worked at several clubs in another city since then and never had a schedule. I came in one or two days every other week and stayed 8-10 hours. The management was cool with that. WHAT IS WITH SCHEDULES?

    Okay, here's the conundrum.

    As an independent contractor, which dancers in the US are, you are basically paying the club to use their services (stage, wait staff, dressing room, etc.). They CAN request you to be there on certain days, and if you have a schedule, then you have entered into a contract with them. They can fine you for breaching that contract. It's the same as if you ran, say, a hair salon. You charge X amount a day for a person renting the chair, and you count on that money. It's not unreasonable to say that if they can't prove they were gone for a purpose, they should pony up the money.

    Basically, if you have a schedule, stick to it. It makes you look good, helps you get regulars, and helps you avoid fines. It's a good thing all around that you got out of the bad club. Without it making you sick hopefully this will be a non issue for you.

    it depends on the club. at some clubs you are an independant contrator; at others, like the one i work at, they pay you a small hourly rate and you're an employee. my club is very strict about keeping schedules. girls who fail to show up are "punished" by having to work extra shifts, doubles or suspension. i think this is an unusually strict situation in our business, but every club is different.

    when it comes down to it, i guess club owners can run their business the way they want to. if they want to fire or fine you, i believe it is legal to do so. perhaps it has to be stated in a contract though...i'm not really sure. either way, i doubt it would be worth any sort of legal battle. so i would suggest either accepting the club rules or finding a new club.

    When I did take in a note from my doctor they said it was fake. I told them to call and verify. My doctor knows what I do and I am not ashamed of my job. The management then hada meeting with the other girls sharing my doctors note and asking where I got it. IT WAS REAL. Now they are under new management. I want to go back because it is close to my home, but I am not in a position to work 4 or 5 days a week. HOW MANY DAYS/HOURS IS A NORMAL SHIFT?

    ALSO, DO YOU EVER GO TO THE DRESSING ROOM TO FRESHEN UP, CHANGE OR HAVE A SNACK? IS THAT ALLOWED IN MOST PLACES?

    again, it depends on the club. your management seems very tough to deal with though. but i still say you've got to either deal with it or go somewhere else. the mangers aren't going to care what is normal; they're going to run the business the way they want to. that said, there are a lot of places with better management; it would probably be worth the time to find one, even if it requires a bit or extra driving. good luck

    Yeah I can't speak for every club, and even though my club has asked for doctors note when I call in sick, they never remember to ask for it the next time I arrive @ work. A doctors note is more than sufficient at my club, usually just calling a few hours before the shift starts is enough as long as its done VERY INFREQUENTLY. Management at my club is pretty lenient, but they will fine you for missing shifts w/o proper cause. We could sit in the dressing room all night if we wanted, as long as we came out for the special "deal" dances and asked the custys. Your management seems pretty stiff!

    Yep, it's pretty standard at most clubs. Just last night, I had to sign an IC form (which is weird, 'cause I've been there for 4 months) basically stating that while I am considered an IC, the club basically has the right to treat me as employee, fine me for calling out, etc. It sucks..but I still think it's better than being an employee.
