An unmarried 14 year old can't have consentual sex in the USA.Originally Posted by lilithmorrigan

A law school trivia test answer: It is legal in New Mexico.Originally Posted by JustJayda

It took place in Texas... but I read it on a UK site, so I was confused. Blah, but still, it's annoying when people assume that everywhere is just like America.

I would also like to add:
This girl met this guy MULTIPLE times for a sexual relationship. She only complained when she found out he wasn't captain of the football team. She played a VERY adult game. I think she should be treated like an adult and can't scream 'rape' just because she didn't get what she wanted when she INITIATED the meeting and INITIATED the sex. She knew what she was doing.
Say a 16 year old boy murders 6 people in a very brutal, but intelligent, way and buries their bodies in several pieces over an entire city block. He knew what he was doing. Should he not go to big-boy jail just because he was a precious BAAAYBEEE and didn't know better?
Both situations; they knew full well what they were doing and should be treated excactly like the age they were pretending to be.

However, the 19yr does not get to break the law because she was willing. The law is in place because it is believed necessary. Well, he does get to break the law, he just is now vulnerable to the consequences of his "multiple" actions. Shit, him doing it more than once, leads me to believe he didn't give a shit how old she was even more! I mean come on, was the 14yr pussy, so good to a 19yr, that he just had to keep coming back!
Until the law changes...he's willingly placing himself at risk.

He had believed her to be 17. She said it multiple times. It's legal then, because the age is only two years apart.Originally Posted by JustJayda

She isn't extorting him. And lying isn't against the law in this context.

Well she lied to govt officials as well about the whole thing when she screamed 'rape' (as in, forced penetration)... so she should at least be tried for perjury.
Not if the rape she accused him was statutory. You can argue that the claim she has does not have moral ground (although I disagree) but you can't claim that statutory rape (in any of its incarnations) doesn't exist.
Plus perjury can only be done under oath. Making an allegation isn't perjury until you are in court.

Agree to disagree.

Further, all sexually active young men should be concerned with this issue, and should do their own research, when verifying a girl's age. It seems like, it wouldn't be to hard to tell, when she can't talk about half the shit 17 year old girls can, doesn't have a driving permit, or numerous other things that would indicate her age. HE DIDN'T CARE!!! She was willing, and that was enough.
For him, getting the ass was more important, than protecting his own.

Proof she was lying about her age was her Myspace where she repeatedly sent messages saying she was 17 and her profile said the same.
THAT'S WHY THE WOMAN IS SUING MYSPACE.
Because Myspace made it 'too easy' for her daughter to fake 17.
Interestingly, I'm having this exact discussion on another discussion board. I think that people are targeting the wrong culprit. Myspace isn't the problem--this girl could just as easily have gone to FaceTheJury, Facebook, AOL, or any number of popular online meeting places that have been around expressly for the purpose of networking. Myspace just happens to be popular right now, so they get the demonizing. I remember being 14-16, too, and the girls my age were having sex and partying and meeting older guys then, too. I wasn't, but if I'd had a webcam and Internet access when I was 16, I probably would've been right on there, too (and my life would've turned out a lot differently, I'm sure).
^^
I get what you are saying, but the case is not about whether teenage girls make good decisions. In fact, it is taken for granted that children will not make good decisions - that is why we have protection for them in the first place.
