    Anyone else in Australia having tax dramas?
    Seems the ATO here doesn't have a clue, I spent 1 1/2 on the phone to them the other day and spoke to three operators and I still couldn't get a straight answer.
    First my accountant says I don't need an ABN, then the tax office says I do because I'm a sole trader (not a sub contractor) it's in some obscure add on legislation under "performing artist", then one boss decides he's going to take tax out so I have to pay my tax to him (he takes it out of my pay before he gives it to me so I don't have a choice) and I have to wait for my group certificate as an employee, his accountant is always late. Then another boss says if I don't used an ABN I have to pay 42% tax! On an ABN if I earn more than $50,000 a year (god why would I strip if I wasn't making at least that) I have to also lodge GST and quaterly BAS statments, AGHH... so am I a sole trader, a sub-contractor, an employee? Should go corporate and sell shares on the stock exchange? If I get sick and can't work can I declare bankrupcy? The whole set up is ridiculous and if they make a mistake guess who pays. All this for a single solitary person with no office, no stock and no material business assets. Bah.

    You do need an ABN .... UNLESS you want to pay the maximum on your taxes of course. Because the tax system will assume you're lying about your income without the ABN and charge the full amount. Had it happen to me.

    The ATO recently went around and gave talks to the bosses down here about their tax obligations. I've got an ABN (I'm on my second, they lost my first one after I'd had it for two years, how can a department that probably knows what 10yos earn on their paper run and would tax them on it if they could just get past those damn child labor laws lose an ABN?), being an ABN holder I own a "business" where's my talk? They're keen to take our money and make us jump through hoops but when it comes to doing the right thing by us they haven't lifted a finger. They're doing it to prostitues too, girls are freaking out thinking they are going to be back taxed. I'm so angry, I'm a tax payer damn it. Where are my dollars going! hmm.. I might just not bother paying tax this year...

    You must have an ABN and you are working as a Sole trader. This has nothing to do with your boss, you should not be paying them tax. what ever you declare as long as it is under 50,000 per year you will be taxed 20% I dont know who told you 42%. Its not that scary you just need a good accountant, preferably one that knows the industry.

    Thanks Rocket. I've had an ABN for some time but never used it, my accountant said I didn't need it just to keep my pay sheets, certificates and recipts but now a lot of employers are suddenly asking me for one thus the confusion.

    Apparently now the employer is required to withdraw and pass onto the taxation dept 42% of your income if you don't give them your ABN details. The tax dept quoted me 20% flat rate under $50,000pa too which sounds about right. Problem is I work for several clubs and agencies and they each have their own way of doing things. It was easier going through the business with group certificates at the end of the year. I guess this means I'm going to have to pay more attention to my paperwork now.

    yeah, i do all my own paper work although you sound like your situation is more complex seeing you work in more than one club. Your a busy girl! I see my accountant quarterly to make sure everything is going well. Oh yes and dont forget to keep all your reciepts babe, everything down to makeup, tanning, nails, and hair, basically anything you need to get on stage.

    Your boss shouldn't be taking tax out as you aren't legally an employee. As others have said, you're a sole trader and need an ABN.
