    Default Agency says No Tips!

    My agency told me to take my tips claim off my invoice for her. She said, 'then neither of us say taxes...We don't want that!' WE? I want that! I'm making a grand or two a week and am only 'claiming' two hundred? I want immigration to know I can support myself so I can stay! It's IMPORTANT I pay tax on my tips. Not to mention my goal is...(cont phone)

    Is to be an upstanding citizen. Are they doing something illegal by having me not claim my tips? They take twenty percent of them! I want to do this right! Is the company doing tax evasion and can I claim my tips seperately to save my own ass?

    YES ! the company is breaking the law! All money that is incoming is considered income, which needs to be declared! INCLUDING TIPS!

    Make a phone call to the tax department and question them to ask them if they are required to declare tips, if you are not happy from there, approach the agency direct!

    As far as I am concerned, NOT declaring money IS tax evasion, which to me IS breaking the law!

    Call the tax department!

    Claim them. It's up to you whether you want to claim your net tips seperately, or claim your gross and use the 20% commission as a deduction. I think the latter is the more legal way to do it- I'd do that- but you can probably get away with the former.

    they take 20% of your tips? On the honour system?

    They give you a base pay and use the honour system to remove your twenty percent from your base pay. They also compare it to make sure you're not undermining them. So my pay gets LOWER the more I make. I invoiced them a x minus twenty percent of xx is xxx. They said to NEVER mention I get tips in my invoices.

    (........now you can see why I don't want to really align myself or work for this particular agency alot anymore........ they did used to give ALOT of work to me however I'm quite happy to be low on their list these days as more and more they prove to me to not be a 'choice' agency in the long run.... stick with quality like mild2wild and such like...........)


    In the end, the only way the ATO can work on what income you do have (are earning) is whatever goes through your bank account (s).


    to everyone else: yes this agency takes 20% of your tips and you must declare them (whilst not actually having this written down on the invoice per-say) as they do know what the average to earn in tips is at certain establishments/bookings as they have had those bookings for years. So the more you earn in tips, the less you are actually paid in re: your base pay as this is mainly concerned with waitressing.

    example: agency pays $40 per hour x 3 hours = $120 for a booking base pay. You have then earnt $100 in tips ... and they take 20% of those tips... which equals $20... so when you invoice them you invoice them as such:

    Friday 13 October Oxley Hotel $100

    you invoice them the final amount ( $120 base pay minuse $20 (20% of tips) = what the agency will pay me ).

    im ment to be doing that, arent i? i just note what i make form each agency and keep it in a file on the computer.

    whats an invoice?!

    Gold, can I have the Australian tax office use my bank account so I can pay my full taxes? I want to claim everything as it looks bad to immigration to see low earnings when my low pay means I earned far more! I need to show I'm supporting myself! An invoice is a statement you give to someone to tell them the price of services rendered to get paid.

    Since you are self employed under our system here the only thing the ATO and anyone can go upon in re: income is whatever is disposited into your bank account. Since this is the only thing (my two bank accounts and whatever I declare under my "cash on hand" section in my MYOB file) my accountant and thus the ATO can use to determine how much I am earning (my income) ... and this is what I have been doing for years... you should be fine to do it too.

    Since alot of the agency work is cash in hand using invoices is only going to help so much esp. during Indy............even that agency accepts cash bookings during Indy (when usually the majority of the bookings one can receive from that agency you have to invoice them for in order to be paid).

    mermaidnz: you only need to invoice if the agency requests it (and thus pays you into your bank account not cash you have received on the night you are doing the booking).
