    Angry My drivers liscence.

    I guess this would be the right place to post looking for advice on this. I know there are some really smart people on this site.
    I went to dmv to get my driver abstract for a job driving for the post office. Come to find out that I had a suspended liscence from 1989!!!!! to 2004. But I always had a liscence. What had happened was in 89 I had 2 cars and one wasn't working so switched plates and got pulled over. Never paid the ticket as I didn't have the $ and moved to tx and forgot about it.
    Moved back to ny and had 3 liscences issued to me and never had it pulled up on an insurance check either. Went and got my cdl class A and never had a problem.
    So when I went to the judge to pay it he charged me 40.00! I was happy that was all,but mentioned I had a suspended liscence. I just said i didn't know.( I didn't)
    This must be why the other co. never called me. So now they must think I'm lying when I filled out the app.
    What do I do? Go see the judge- can he take it off? Go to motor vehicle? Or hire a lawyer- which I honestly cannot afford?Any advice appreciated. TIA

    I was all of 19 when I did this. Feels wrong to be getting screwed for it now.

    There might be a statute of limitations on the suspended license/ original ticket....If you managed to get a CDL Class A License & it never came up....well...

    Go ask the judge, or better yet, Legal Aid (you can get free legal help through them.) This is seriously a no-brainer. The paperwork & manpower the state will expend to extract a fine out of you will exceed the value of the original ticket. Geesh.

    OMG - all I can say is good luck.

    My boyfriend lived in west virginia all his life, and had a WV liscence. He was pulle dover in PA for illegal street racing. He was fined, and PA made him up a PA liscense, and then revoked it. He never knew this.
    We move to Las Vegas, and he tried to get a nevada liscence. They tell him he cant get one because he has a suspended liscence in another state. He says no, I have my WV liscence right here. After some digging, he find out what PA did.

    He has spent over 5,000 dollars on laywers. Fought with Pendot hundreds of times. He has called state senators. Pendot says they will not remove the revoked liscense from his reconrd until he completes the sentance, and having a suspended liscense for 6 months. He told them its been 5 years since that happened.
    Apparently, since he never ACKNOWLEDGED the suspension(cause he didnt knwo he had one) he was ineligable. He said fine, I will acknowledge it. That was 2 years ago.
    Pendot still wont remove the suspension.


    We dont know what else to do. His WV liscence will expire next month, and he cant get a new one.

    Sorry, there is no statute of limitations on any fines levied by a governmental agency.

    You are better off going to legal Aid and seeing if they can help you. If you know the judge who helped you last time, you could always go see him...but if you do not, it probably wouldn't work because they see hundreds of people a week and he probably won't take the time to help (but you never know!!).

    Otherwise you need to find out the TERMS of your suspension. Suspensions are temporary and rarely last more than a couple of years. Revocations are permanent...and if you do not get it done immediately (now that you know) it can make situations much, much worse.

    As for the state-to-state move and getting new stuff...not all state computers are linked...and not all states are on top of updating information for other states to use. Joe had a parking ticket in Oregon, moved back to Illinois and got a new license and he found out that there was an outstanding ticket on his record...which he was pulled over and arrested for on numerous occasions (I had to bail him out of jail at 3am when Makayla was 2 weeks old). The ticket was SUPPOSED to be marked as paid in the system...but we could no longer find the receipt and it took Oregon 1 YEAR, 8 court dates and $5,000 (some of which we got back) to update their outdated system so that Joe could drive and not get arrested.

    Legal Aid will be able to help you find out the information you need to move forward. Go to them ASAP and find out what happened. From now on, if you ever get a fine levied against you, you can go to the judge and ask for a payment plan. Most municipalities will offer a payment plan to pay larger fines. It sucks, but its better than ever having to go through this again.

    If your boyfriend "served" his suspension, then PADoT cannot refuse to remove it from his record.

    Were your lawyers Vegas based or were they PA based? A good PA based lawyer (in the municipality of where the suspension was levied) should be able to get the terms of the suspension, proof that it was acknowledged, and get an order by the court of release from suspension.

    It may cost you a bit more money for a PA lawyer (if that is not the way you went to begin with). But, it should clear it up pretty quickly.

    If you had a PA lawyer and they couldn't get the suspension lifted (it would still show up on his Driving Record, but it would show as "released" or "inactive") then there is something else going on that you haven't spoken of.

    There is no statute of limitation on a suspended liscense. The reason it never showed up is 1989 is before all DMV's went to computers and linked up nationwide. It will be on your record untill you fix it unfortunately and there is no way to permantely expunge it. After about 10 years (from the time paid) it will no longer show up on background checks. It may not have shown up before, however once they did the check in NY and found it, it will probably be entered in the system nationwide now, and will therefor show up on all background checks in all states. You may try a lawyer and they may be able to expunge it from your record, but I would make sure you get a free consult first.

    Vegas dancer I will keep you posted. Crud. Getting a lawyer is impossible for me now. It will probably take me sometime during the week to look into it.I had a great job lined up,but this will kill it.

    The laywer was in PA.
    Pendot just keeps screwing around. One person will say it was lifted, then we go to get the nv liscence, and they say its still on there. Then another Pendot person will say they never recieved the acknowledgement. So we sent in in again, waited another 6 months. Still nothing.
    Spoke to another person who said fax in the paperwork. So we did.
    Called back and someone else said they dotn recieve faxes. So we mail it.

    Talk to another person and they said they haven't recieved any of the paperwork ever sent in. So we rounded up all the paperwork from the course of 5 years, including the letter from the judge when the court hearign for the ticket, the letter says, he served his sentance, paid the fine, and is eligable for a liscence.

    The letter from the judge did no good either.

    We mailed Pendot all the acknowledgements we have sent in over the years, and still are getting the runaround.

    ^ Are you fucking kidding? Holy shit. I thought our ordeal was pure hell.

    Are you CERTIFIED mailing these letters/correspondence? That way, you'll have GOVERNMENTAL proof that someone at that dept. signed for the letters.

    You may have to start going up the chain...if that means starting a letter/emailing campaign into this problem. If its happening to you, its happening to others. Contact the local newspapers and tell them this. Newspapers love to write about this stuff.

    The more vocal you are about this, the more you'll get done.

    I hope that helps. I'm kind of at a loss for this. Let me know how it turns out.

    Given your string of attempts, this doesn't help much, but just FYI, there's a thing called the Nonresident Violator Compact. A quick Google popped up this description:

    The purpose of the NRVC is to standardize methods utilized by the various jurisdictions to process non-resident violators receiving citations, and their failure to appear or otherwise failure to comply with outstanding moving traffic summons.

    The compact allows participating jurisdictions to inform each other's motor vehicle administrations when a resident of one jurisdiction did not comply with the citation’s terms. Once the home jurisdiction motor vehicle administrator receives notice of a resident’s citation noncompliance, the procedure for license suspension is initiated.



    But please understand, good people, that just because the license is suspended doesn't mean the state feels it has to notify you. Indeed, you may not know about it until you get pulled over and it pops up in the cop's computer screen.

    we recently( withinthe last 2 years of this ordeaal) started sendign the correspondences certified. It doesn't help because every time we call, we deal with a new person, who says the last person we talked ot was wrong. We have tried to talk to or get ahold of the same person every time, and alwyas ask for their ID number when we talk to them, but that doesn't seem to help. They alwyas just say that person you talked to last isn't available.

    Its hard to fight this from another state. At one point someoen told him that he needed to walk the paperwork in to Pendot. That is hard to do, beign that we now live on the other side of the country.
    His father is in WV, and has been the one fighting on that end, and dealign with the PA laywers.
    We have also contacted NV laywers to try and fight on this end to get the hold removed from his record, but there was nothign they could do.

    I should try to see if I can find other peopel how have had this issue.....mabye try to form some kind of class action lawsuit?

    He was pulled over and this all occured at age 17. He is now 24 years old.

    The best part was he had renewed his WV lisence since that occured, and with no issue whatso ever. Apparently, there was a new country wide system put in place since then, that if you have a suspension anywhere, you cannot get a new lisence.

    GRR>..pain in the ass.....
