    The first problem this issue will face is that the US Supreme Court (just prior to the appointment of Roberts and Alito) ruled that employing eminent domain for economic development purposes was constitutional, and the offshore developers are willing to pay. The second problem this issue will face is that this 'privately owned (by foreign interests) toll road will pay out a significant percentage of the tolls charged to the states that the road passes through, while the states don't need to invest anything other than signing paperwork, which amounts to 'money from nothing' from the point of view of state gov't budgets. The third problem with this issue is that, like the border fence, opposing it will absolutely be met with accusations of racism in the media, which will dissuade organized opposition. Fourth and perhaps most important is that America DOES need an official right-of-way for new gas and oil pipelines, new electric transmission lines etc., which in the absence of a bundled project like this one have successfully been stopped by environmental and NIMBY interests every time they have been proposed.
