    Default apartment question

    (Before someone succumbs to the temptation to reply "just ask the leasing office" ...yes, I plan to do that. But I'd like to not be completely ignorant when I do.)

    How likely is it that an apartment leasing office will allow me to pay six months' rent up front in lieu of having a co-signer or showing past income tax returns?

    Hell, technically I could pay the whole year's worth of rent upfront if i HAD to. (Obviously I'd rather front only the first half of the lease term's rent $, though, since much of my savings is earmarked for other things.)

    I started dancing in July of this year, so my income tax returns from last year will only reflect the piss-poor $5000 i made in '05. I don't want to have my mother co-sign, b/c she is the epitome of toxic and emotionally abusive, and I don't want her having anything to do with my living situation. (I also don't want to run the risk of her finding out where I work--which could happen when they do a background check on me and she, as the guarantor, has the right to ask for the results). Can't ask my father either, as his credit is shot and he's $100,000 in debt.

    So unless there's something else I don't know about, fronting the rent $$ seems to be my only option. But will the majority of leasing offices allow that as an option, or is my current apartment an exception?

    Second question: My current lease prohibits subletting. In my understanding, subletting would be me simply allowing someone to take my place in the apt. without changing anything on the lease. Am I wrong? Does "no subletting" also include "no transferring the lease officially to someone else"?

    My current roommates are dealers, and maybe I'm being a pussy about this, but I want out. I'm not comfortable living in an apartment with drug shit going on. (I'm not talking about them coming home and occasionally smoking a blunt, either.) I don't want to turn them in or stir up drama; I jsut want to get the hell out and move someplace else. One of my roommates has a friend that is interested in taking my place on the lease. But would a "no subletting" clause in the lease prevent us from doing this?

    argh. like I said, I plan to talk to someone in the leasing office about this, but I'd like to have a general idea of how plausible what I'm asking for is.

    I was on an apartment with roomates and wanted out. We just didn't tell the man co I left. The rent was still being paid and that was that. The man co never knew that one roomate was replaced. Actually, I think I'm still on that lease (didn't have to renew, lease automatically went monthly at the end...). Keep in mind I was only on the lease, not a leaseholder. The difference is that being on there makes it legal to live there, being a leaseholder makes you responsible...

    If it's a huge man co, they'll prob not let you get away without a credit check and all that. If it's a landlord or a smaller co, they'll prob let you.

    It's quite common in Australia to pay 3-6 months rent upfront as an incentive for the renter to give you the apartment (you pay a deposit and first few weeks rent in Australia BEFORE you're approved... very weird, but yeah).

    So I don't see why not.

    I am a leaseholder (so is Roommate #1, Roommate #2 is only ON the lease). That's why I'd want my replacement to take my place on the lease, officially and on paper....if at all possible. So i'm not responsible if he ends up not paying rent. I know there is a legal form used in MD called an assignment of lease, which is used to transfer one person's share of a lease to another...but without running it through the leasing office...i don't know.

    Why don't you just kick your roommates out, then? I think it depends on the apartment complex... Like some will let you and some won't. It might also be hard to get someone to take your place on the lease when there are illegal activites going on.

    As for your first question... My ex hasn't even filed for taxes... EVER. He paid an extra two months rent when he moved in and was fine.

    that would be satisfying , but legally I can't kick them out. Roommate #1 is also a leaseholder. technically I suppose I could try to kick Roommate #2 out as he is only a tenant, but Roommate #1 would never go for that. We're 99% sure we've found a willing replacement (one of the roommates' friends) for me. *fingers crossed*. Now all we have to do is try to get the leasing office to agree to LET him officially replace me.
