    Default 16-year-old totalled my car... (semi-rant)

    I could just die right now. It happened Friday afternoon.

    I go to Lindenwood University in St. Charles, MO, my parents live in St. Louis about 15 minutes away. I got out of class at 3, loaded my crap in my car to go home for the weekend and left. I got about two blocks up the main road and this 16-year-old girl in a brand new car slams into my passenger-side right at my front tire.

    Seriously, I was in the inside lane next to the turn lane (5 lane road) in the middle of traffic waiting to get on the highway and the guy next to me lets this girl out of a parking lot and instead of staying in the outside lane, she comes all the way over and wrecks my car.

    So... I have no transportation, I'm in a neck brace for the next two weeks and I missed work Friday night. My car is totalled, it was my parent's present to me when I graduated high school, now I have to find a new car. On top of everything, State Farm (her insurance company) is going to pay for me to have a rental car, but they screwed up my reservations in the computer and now I can't get it until Monday morning, so I have to miss my first classes on Monday.

    This is bullshit.

    Yeah, don't sign anything from the other insurance company and DO NOT TALK WITH THEM!!!!!!

    Get a lawyer and get what you are legally owed. Most insurance companies will try to get you to accept the little bare beans agreement.

    And, in case you didn't see it the first time: Don't sign anything from the other insurance company and DO NOT TALK WITH THEM!!!!!!

    Yis...getting in a wreck that was the other guys fault was the reason I got to go school clothes shopping one time in my life before seventh grade. $$$$$$ Suuuee!

    I dunno what it is with the little 16 year old brats in this town!
    (One ran a red light and plowed into my grandmother's car and tried to make my grandmother the bad guy! BTW: Grandma's fine and the car's gonna get replaced.)

    I hope you feel better!!!! Id get a lawyer/do what you can to get what you deserve, but just remember we were all 16 once.

    My parents bought me a bus pass when I was sixteen. Definantly do not talk to the other insurance company at all. Yes, we were all teens once. My stepmom never let any of us drive till we were 18. She believed that the teen brain does not understand consequence at 16. But on the other hand neither do some 85 year olds who run over people accidently while thinking they were stepping on the break.
    Anyway back to the topic I hope you are feeling OK. Do you have any pain?? Did you get any witnesses to the accident??

    Along with Venus' comment, I was stupid enough to talk with the offending driver's insurance company about settling in the beginning. I had been t-boned in my driver's side trying to go into a public driveway while the other driver cut across traffic to go in the same driveway without looking. I have permanent back and neck damage, nerve pain, etc to this day.

    The other insurance company got together a settlement for me, claiming it was a great one. I added it up and saw that by her calculations, I'd only be getting a paltry $950 to have for myself for my pain and suffering after my medical bills. I thought she was trying to rip me off, and I told her so (the agent) and she got very upset at me. I called a lawyer and found out not only was it ripping me off, but there settlement was way unfair. The total amount did NOT include all medical expenses by a long shot, and definitely no pain and suffering at ALL. So I would have been stuck with more bills and no comp!

    GET A LAWYER!

    Arg. When I was 16 (already living on my own), I was turning left in a yield intersection. When I began the turn, there was a white pickup truck almost an entire block away. I was in a huge retarded Aerostar and was making a slow turn. When I had almost completed the turn, the fucking truck rammed into my side, almost flipping the car. There were no skid marks (as in they didn't brake?!), and the other car was filled with two old people who were speeding in a 35 mph zone. The car was totalled, and the side was crushed in 2 feet. My friend had very slight trauma and because we were minors our insurance had to cover ambulance expenses.

    The guy, after the crash, got out of the car and ran around spitting and calling us "stupid little cunts" and saying we "ran a red light". Uhh, yield intersection?

    The insurance company said I was 100% at fault by quoting a clause that said:

    a) Cars must yield when turning yadda yadda

    b) if a car is already turning, oncoming traffic must yield.

    MY DUMB ASS DIDN'T FIGHT IT ARRRRGGGGGGGGGGGGGGGGGGGGGGGGGG

    Life lessons, yes?

    It was just easier for the lazy ass insurance companies ( who made their decision before talking with my friend who was in my car at the time!! ) to pin it on the 16-year-old. It's unfair.

    Update: They officially totaled my car yesterday and she has been found completely at fault by the insurance. They are giving me 1900 for my car that I paid 750 for and is worth about 1400. We were prepared to take 1800. So that's getting taken care of.

    I am getting a new car that is 5 years newer than my last one. (power windows and everything, yay! i'm stepping up in the world.) I should have it by the time they take my rental car away next Monday.

    We still don't know about the medical. My neck has not gotten any better, thus far, and I'm still having pain in my spine/back all through the shoulder-blade upper back area. If I still have pain next week, I have been refered to a neurosurgeon. We can't and won't talk numbers with State Farm about any of it. They have been made aware that I was injured, I was in the hospital and it is undetermined as to whether or not there will be future medical bills.

    Question about lawyers: Don' t they take like HALF of your settlement?

    Uh...State Farm? Have fun! They are a GREAT company...if you are on their side. If not, they tend to be real sticklers.

    Do you have your own insurance company? You can speak with them, if you'd like. They'll give you the information you need. And, do NOT, I repeat, do NOT talk with anyone from State Farm. If you do not have a lawyer, refer them to your insurance company. They'll deal with them...anything you say to SF can be used against your claim, so just refer them to whoever is handling your claim on YOUR end.

    i got rear ended on my way to work friday and state farm (his insurance) is accepting all liability. i'm taking my car in tomorrow to get it fixed and i'll get all set up with my rental. they haven't been bad to me at all... and i contacted them directly to make the claim against him.

    Yeah. I had to talk to them directly too. They're pricks, though, imo.

    I have Progressive, and they have been great through this whole thing.

    They'll take care of the absolute basics immediately. However, when it comes time for them to pay out for medical expenses, etc...they'll sit on the purse strings and make you fight them for the money you deserve. While they're good for that when they're YOUR insurance company...it sucks to deal with them when they're not.
