    Default Is this legal?

    My boyfriend moved out of his old apartment which he was renting with my ex dj. We had a girl that was a friend of one of my good friends come in and take over the room (no leases signed or anything.) We agreed that she would pay 500 a month and my boyfriend would cover the rest of the 250. Well this girl ran out on the apartment and my boyfriends old roommate had to pay her share of the rent. She hasn't returned but all her stuff is there. My boyfriend now has to pay the 500 from when she was living there, and also 750 a month. So he is going to pawn her stuff to get the money that she didn't pay. Is that legal? She left all her stuff there but if she returns and it's gone can she take legal action? I worked with the girl at Risque, she was nice, but drunk all the time. No one has heard from her, not our friends, not the dj, not the managers. She is gone and won't answer her phone...

    I believe if it's left at their house it's their property, not sure. I think I've seen a similar case on a judge show on tv. They'd probably consider her belongings "abandoned".

    I believe as long as there'e been serious, documented attempts to contact her, her belongings are now considered abandoned. However, if there is nothing in writing saying that she will pay a portion of rent, you don't have a leg to stand on.

    Your boyfriend should've done whats called an 'assignment' - which is legal documentation that this girl was the new leaseolder in place of him. To assign a lease, technically, you'd have to get management approval. As said above, only then could her property be considered abandoned.

    ^ yea i was wondering that, did anyone file a missing person rept? i believe that's correct, that if someone's stuff is left at your place, it's yours. but i wouldnt get rid of it, just due to bad karma, and what if she's lost/hurt/worse somewhere and ... well i wont state that bec i'd hate for her to be hurt.. but wait on it a bit.. if she's missing, the cops will need her stuff as a guide to help find her.

    I dont really know the girl, so I dont know if she is hurt or if she just went to Florida because I know her dad lives there. Ill have to ask my friend if this is normal of the girl. She seemed like the flighty type so I wouldnt be suprised if she did just take off, shes very immature that way. At least thats what I take from the few times I have met her.

    Hmmm... I know a landlord can sell of ONLY what the owed rent is worth... but I dunno about fellow tenants.

    No, you can't touch it. I had a roomie do this to me, one time. Walked out owing 3 months rent...so I took all of her stuff and moved it out into storage. She came back a couple weeks later and called the cops because her stuff was gone. You cannot touch anyone's stuff without a court order/decree saying that they've abandoned the stuff.

    Around here the landlord has to store the goods for 3 months before they can be sold/destroyed/whatever.

    I don't know what the laws are like there, but we had that situation and thats exactly what they had to do, pay to store it for 3 months before anything happened to it.

    Damn oh well. Just wondering, the lease is up in two months, what happens if the dumb girl doesn't come back to get her stuff? My bf nor his roommate are going to pay for storage for her things...

    ^ just leave it w/ the landlord, tell him it's hers.

    that way it's on his baack (the legalities of abandonment and w/ev)
