    Default I moved ............. I think???? (WARNING: LONG!! YET ACTION PACKED)

    yet also at the same time!


    Here's the story:

    Monday 12 Feb - I hand into the Real Estate Agent my lease to re-new for a further six months.

    Tuesday 13 Feb - I get a 'friendly' phone call from the RE Agent to inform me that I have been given a Notice To Leave. They even pointed out that they had 'hand delivered' one of the notices on Friday 9th into the mail box. Since I don't get much mail to my home address for security reasons I don't check my home mail box often around once a fortnight. I had no idea about this "Notice To Leave". I subsequently after the phone call checked the mail box and there they were... and it stated we had to be out of this unit by 5pm Wed 21st Feb.

    The hunt for a new place and the stress that goes along with it (and I was STRESSED!!!!!!) started for me the next day.

    Oh yeh we had also asked for an extention of approx. 5 days on that notice so then we could have plenty of enough time to find a place and move.


    Fast fwd to Friday 16th Feb.

    Fri 16 Feb: In the morning I had received news I was denied two properties. So I was a bit down on myself and in a little bit of a state of panic because it was Friday and both my flatmate and myself had to be out of the current place by Wednesday. I couldn't book any removalists or anything because I hadn't secured a place. Then Friday afternoon I received a phone call that I had been approved for one of the many properties that I had applied for that week. I took it. I paid for the bond on the spot as the money was already in my account waiting for me to use it.

    By the end of Friday I had not heard back in re: an extention so I naturally assumed I wasn't granted it. Just like anyone else in my situation would .. right?



    Sat 17 Feb: Due to time ticking ever so closer to the deadline of Wednesday and the joy at having secured a place (it wasn't totally ideal.. it was a much smaller unit, furnished and higher rent, carpets etc... the only good things were that it was real close to the vet - one street away - and the neighbours beside and below us were all pretty kewl)... I went into the RE Agent office first thing (as soon as they opened) and signed the lease agreement so I could start moving pronto!


    Sunday 18 Feb: Started moving.

    Monday 19 Feb: Secured a storage shed as I thought at the time because of the smaller unit and it being partly furnished I would be needing the storage shed to store my 'excess' furniture amongst other items (all boxed). Paid for a fortnight's worth of hire. Organised the removalists for this Wednesday. Organised "tenants cleaners" (they do what is called a "bond clean" ... clean the place top to bottom including carpets ready for inspection) for Thursday as they would need a good 6-8 hours access to the unit and by that time (at the time when I made the booking) the furniture and everything was basically going to be gone. I was going to be out of the unit by Wednesday 5pm.

    SAME DAY

    I receive a phone call from the Real Estate Agent of my current unit (not the one I was about to move within) informing me that in the end that my lease renewal was acceptable.

    I WAS ROPE-ABLE!! I WAS SO PISSED OFF I WAS SPEECHLESS!!!!!!!!!

    All that was going thru my head was "NOW You tell me... almost a week after I handed the lease signed and ready for renewal a week ago... making me panic.... making me think I needed to be out of this unit by Wednesday... making me spend thousands of dollars .... NOW YOU TELL ME IT IS OKAY TO STAY?!?!"

    So I took a moment and had to make a decision. Do I stay or do I not break my current lease for the new place ... do I continue moving since things had been set in motion ? I had decided to continue with the move as I had made the committment both in writing and financially plus secured a storage shed because of the smaller unit etc etc.

    A few more hours pass.... I get a phone call from the owner. He has always had my number and I have always had his. He asked me what was happening as to his surprise I was being asked to leave. He plea-ed with me to stay ("stay as long as you like" his exact words). He didn't want me to go. The owner does like us and we don't have any problems with the owner. It seems the RE Agent had given us the Notice To Leave without ever informing him about it all. It was only today that he found out and not from the RE Agent (the neighbours below us who own both the bottom units saw that we were in the process of moving and were a little surprised themselves).

    All this time both my flatmate and myself were under the distinct impression we were being kicked out (this was a theory) because the owner wanted to reno the unit so he could ask for a much higher rent than he could get out of us legally via a lease (as you can only increase rent by a certain amount each time the lease is renewed).

    We had come to that conclusion based on the fact that I personally had seen how competative the rental market locally was that past week attending upteen amount of inspections !!!


    BTW, we had boarded the cats (remember mine is ill still and my flatmate's cat is diabetic) at the vet since Saturday. I visited them both twice today.. by myself and then with my flatmate. My cat was doing alright there (she really does know the place and people well enough now) whereas my flatmate's cat (Puddy) really really didn't like being there. He doesn't like cages or anything that confines him too much. Plus he would've been missing us and his familiar environment.

    So there is a cost I'm not going to re-coup! Grr. Not to mention all the wear and tear on my car!!!!!!! ARGH! The petrol I had used!!! Fuck.


    So now we are going to stay. The owner now wants to deal with us directly and not have to work thru a real estate agent again thanks to this whole 'adventure' ... I'll know more tomorrow.

    Yes that means I am breaking lease at the other place. Yes I am going to 'pay' for it financially because I'm breaking a contract as such .. even if I havn't spent a full week there or even moved in completely (I would say we were close to half moved in). I just hope I can still have the keys for two more days so I can remove what I had moved in ... as I will still use the removalists as I still need them to lug all my stuff I want to put into storage. I will try to move most or all the rest of everything tomorrow back home here.

    The stress. The financial drain. The money I am now never ever going to see again. I am so over all this....

    I'm staying even tho' I don't totally love the unit I'm within because the owner said he would be willing to go cheaper on the rent because he won't have to pay the RE Agent anymore so I will definately stay for that reason.

    I'll also still get the cleaners in to clean the carpets even tho' I'm going to stress to the owner now that I'm dealing with him direct that the carpets desparately need replacing from seven years worth of wear and tear as well as the bathroom needs to be urgently looked at since the tiles etc are starting to come off the wall.

    Wow--I can't believe they told you to move when you didn't have to. I am moving to another apartment in june and just reading your story stressed me out!

    Wow.

    Did you find out what the deal is with the real estate agent? That's really not good business to randomly kick people out into the street. Is there any way to recoup your costs from them?

    The kitties are going to be happy to come home, that's for sure! No having to figure out new litter box placement or anything.

    Honestly, I would raise Cain with the RE Agency- just keep going higher and higher up until you find someone who'll get you your money back. (And see if the owner of the place will call and complain too!)

    The financial drain might not be over yet if your 'new' landlord decides to try and hold you to the terms of the 'new' lease you have already signed and paid some money towards. This could mean you'll be required to make monthly payments for the 6 / 12 month term of the lease even though you aren't living in this 'new' apartment. Depending on the terms of the 'new' lease, you may not be allowed to sublet either in order to recover some of the costs.

    That's one of the great things about Australia is that I may be penalised for breaking my lease however ultimately I can do it. People break their leases all the time here. Goodness, I saw quite a few "breaking lease - must rent now" listings when I was hunting around for a place just that they go pretty darn quickly because the lease is being broken.

    I'll probably loose a little bit of a bond money yet get most of it back.

    I'm going the the Rental Tenancy Tribunal (or similiar) to see what my rights are within this situation as someone obviously stuffed up if I am allowed to stay in the end and the owner wants me to stay .... so the fault definately does not lie with me.

    I'll keep everyone updated.

    SUE THE REAL ESTATE AGENT OR HAVE HIM DO IT TO RECOVER YOUR COSTS. They did dsomething without their client's approval. Illegal. Bad PR. They must pay it or it will go public.

    I've had a problem with my real estate agent today too!!! Later I'll tell you the story about how the apartments CAUGHT ON FIRE, I was WITHOUT electricity... and they told me they'd send someone in the morning (which was bad enough!) and never did.

    And I would've continued moving... they don't give the bond deposit back.. which is usually, what, 1-2 weeks rent?

    Well.. at least your carpets are cleaned?

    you have been ranting on for months now about how you wnana leave the place you were in, and move somewehre new cos you had been there for 7 years or whatever. and now your moving back there?!

    ^Yeah... I remember that... I don't see why you just didn't continue moving? You didn't like the place much... you wanted to move... you already paid everything TO move.. and you only stayed because you were accepted?

    Because now that I don't have to deal with the real estate agents ... I'm dealing with the owners direct and their preferred "repair" guy I will get things done! FINALLY!!!!

    (Morr can attest by her post how unreliable sometimes the repair etc guys can be when done thru the real estate agent and because you don't have the repair guy's number and only the agent's number... you can't see when he will be around etc... you can only call the real estate agent... whereas now I have the landlord's number and the repair-guy's number... direct communication now.)

    Yes I want to move out into Southport .. a place with a yard.. and so forth however I am now going to be having a pretty damn good deal going here in the end (I spoke with the landlady direct about it all).

    My main problem with this unit was the fact that it was and is in such a fucked state right now and needing some love. Now that I'm dealing with the owner direct (and with her father when she isn't around) I can be guaranteed these little niggling things that is wrong with the place is finally going to be fixed!

    Not to mention they know about the cats and are okay with them. It is VERY hard to find a place that will be the same amount of rent I am going to be paying (less than what I was paying which was $225 per week) that will allow me to have the cats.

    The bond is 4 weeks worth of rent. You also pay up-front on top of the bond two more weeks worth of rent to get started and keep the rent "ahead".

    I also didn't continue moving as I wasn't a huge fan of the place we were about to move within. The only plus-es that 'new' place had was its location to the vet and the neighbours seemed friendly enough otherwise it was a bitch of a place for either of us to move within (even if I did move in by myself).

    Anyway, I've already started to advertise to get tenants for the other place... at work, EmailCash in their Classifieds section, at domain.com.au ($132 cost), and plastered myspace with my 'ad' ...

    I'm quite happy to keep paying rent at the other place til I find someone. When I find someone I will get them to apply for the unit and once they are approved then I will break the lease. I won't get the real estate agent whom I am breaking the lease with to do any work so that I can hopefully get all my bond back.

    Even if I don't get all my bond back (I should as I am doing the work here and not getting them to re-list the place and still paying rent).... my landlord is behind me in getting the real estate agent who fucked up to pay me.

    The silver lining is that it is getting us (my flatmate and myself) organised. There was a heap of stuff that could easily go into storage... and stuff that needs to be thrown out etc... and I'll still get the carpets cleaned etc... this means now that there is more room.......... and the garage which is a double garage will have more room......

    If they accepted cats, I would seriously think about it... especially with my fire and water and electrical damage to my flat right now... two bedrooms for such a low price... mmm.... I need an extra bedroom for the birds now.

    It's a small unit. It wouldn't suit anyone with animals even if you did so illegally due to it being partly furnished. There is a no pets rule however the same is said about this property and we've had the cats here for many many many years without too many problems (well, the landlord wants us to stay so they must not be that much of a problem).

    You really shouldn't be getting places that say no pets with cats anyway.. the SECOND you get a black mark on your renting record... it's super hard to find a place.

    I actually got the first place I applied to with cats and everything.. I just had to ask and then pay a deposit.

    Nobody even cares about birds, haha.

    I shouldn't get a black mark as I'm renting privately now. As I said, this current place the cats are acceptable even tho' I technically can't have them here as the landlady (and her father who I deal with when she isn't around) knows about them (and wouldn't be wanting me to continue as a tenant if she really did have a problem with them).

    I was referring to the fact you almost moved into a place where it wasn't acceptable. That's kinda not cool. You can get an apartment with a cat pretty easily if you just pay a higher bond.

    Not on the Gold Coast. I looked. The Gold Coast isn't too pet friendly a place. Heaps of people (and I mean heaps) rent units etc with pets illegally. Not saying it is right just that it happens.

    Anyway, what is done is done. I'm not moving. I'm dealing with the landlady direct now. Much easier. She's kewl.
