Default Can I return a car in Florida?

My fiancee not being the most intelligent person decided this morning he wanted to buy a car. He went through drivetime and got a car that was completely out of our price range. I called the dealership and they said no returns but my mom mentioned something to me about a recsinned (sic) law and I'm hoping someone here has information about this. Thank you

I'm fairly certain ever state has a lemon law. Other than that it's dependent on the dealers policies, there is no legally mandated grace period.

I think that there is a 3-day right of recision law. I know it's here in IL...but, if I am not mistaken, the right of recision is mainly on products (like gym memberships, etc). On refinance loans for homes, you have a 3-day recision period...

But, for cars, once you sign for a title (take a loan, etc) the car becomes used and cannot be returned.

Kick your fiance in the ass for being careless. Not only do you have a car that you cannot afford, but when you go to sell it...you are going to take the hit of depreciation (if the car is brand new, the depreciation can be around 20&#37 even if you only had it for 1 day.

This is what happens when people do not think through their choices and impulse buy.

That's what I've always thought too, but laws vary from state to state. I know it's like that here in Texas. Maybe Google it on the net or talk to a lawyer

LOL when I saw the title, I thought it was going to be a question about whether one can rent a car, drive it to Florida and return it there.

In IL, the three day law, only applies to people that come to you to sell something, like a door-to-door salesman type of thing, as well as purchasing real estate (I think). Trust me when I tell you that it does NOT apply to cars (in IL). I learned the hard way, when I was young and stupid. Luckily, my uncle is an atty and helped me out of a bad situation.

I don't think very many states, if any at all, have a three-day law for car purchases, with the exception of the lemon laws.

NOOOOOOOOOO YOU DID NOT BUY FROM DRIVE TIME OH GOD NOOOOOOOOOO

I bought from them when I was young and stupid with no credit... NOOOO they Fucked me! No they will not take the car back, plus I paid 25 % interest on my car, which was a used rental car that looked great but had all kinds of problems AND the interest was locked into the loan, so even if you paid off the loan early you had to pay ALLL the interest!!!

NO!! Oh well girl, hope he likes the car.

If he just got it yesterday or something he should have a week or at least a few days to take it back... but maybe not... do you know a lawyer?

This is also true for gym memberships...and the like. It's always in the small print of the contract, but if you are not sure whether you will be able to return it, always ask. "If I decide that I don't like ____________, will I have a recision period in which I can return the ______________ and get my money back?" If they say yes, be sure to get the exact date that you have until AND the exact terms in which you can return it BEFORE YOU SIGN ANY PAPERWORK.

I did too. I was gonna say you usually can return a rental to any location within the company's network, BUT they charge you extra for that. Sometimes alot.

Girl, I hope you are not gonna let yourself get stuck paying for that car.

Honestly, I do not know how you can deal with someone who is so financially irresponsible. I would have been like, now that you have a new car, you can hit the road. I mean, if he impulse bought this car, you know he's going to impulse buy other shit even after you told him not to.

    Wow.

In my case I ended up paying $27,000 for a vehicle with a sticker price of $13,500.

    It's no bullshit.

I wouldn't like to be with someone with that kind of debt and so irresponsible. I prefer a man who can help me in my decisions. ...Not someone who will comehome and say our house has been traded for some magic beans, if you get my drift...

    Wow.
Yep. Car's in his name, let him pay for it. If he can't, tough shit, he shouldn't have bought it expecting you to pay for it. It will get repossessed and fuck up HIS credit. I most certainly would NOT marry someone like this because you'll wind up paying for his irresponsibility indefinitely, and hating him (and yourself) for it.

yes, hopefully it's in his name! Though I don't see how he could put it in your name if you didn't agree to buy it. Definitely think really hard about marrying the guy. My ex bought a jacked up high interest car like that and was TERRIBLE with money. I couldn't live with him anymore and had to leave.

I realize the original question was about returning the car, so I hope I'm not overstepping or offending here.

IMO, not only would you be enabling him by paying for the car, you could be lowering the bar for how you expect to be treated. His irresponsibilities are not your responsibilities and this is the perfect time to illustrate that to him. Obviously you love the guy and it doesn't sound like you are interested in leaving him. I would however, suggest that in staying with him you do so exhibiting the utmost respect for yourself and use this as an opportunity to set the standards high now. Use tough love. Treat it as a big mistake and empathize with him, while making it clear that it's still his mistake and not your mess to clean up. Let him suffer the consequences of his own actions like Bridgette said: Car gets reposessed and he screws up his credit, or maybe he has to get a second job to cover the extra cost. Either way, that dose of reality would hopefully be a learning lesson for him, and a liberating practice for you. He won't learn anything good or fruitful if you bail him out. I'd let him deal with the car. If he's like everybody I know who's been through this, he'll never make that mistake again.

"Well, I can pick up a newspaper for you to scan the classifieds, but that's about all the help you're gonna get from me on this. I love you and I'm sorry you made a bad decision. But you're crazy if you think I, or any normal person for that matter, would or should pay for your mistakes. " I'd probably welcome him to the real world somewhere in there too.

If it turns out that not bending means facing being alone, consider that it's kinda hard to move forward if you're constantly bending over backwards for somebody else.

    Good luck Alexis.

I bought a fuckin Drivetime car too....not very long ago either. I would never have made such a huge and financially dumb purchase if I had known I was pregnant at the time. I really didn't think I had another option because:
    1. I couldn't prove my employment/income because my bank records didn't reflect my income. (the DT lady creatively used my SC manager and my own business stripper name as references)
    2. My old car was dying and I couldn't afford to keep replacing parts (a 91 Jaguar! I really needed something else quick)
    3. I have horrible credit.

I was a sucker and an easy sell because I was desperate. That's how they get you.

I looked into returning it. The only thing you can do is stop making payments and have a repo on your credit. Or you can keep paying for the car. I will just suck it up and do the latter, hoping that nothing major goes wrong with it mechanically.

I HATE THEM. And I'm angry at myself for falling for it. That's all I'm gonna say. The car isn't technically a lemon, but my aunt explained to me that those cars come in on fleets and are used by businesses and treated like shit, usually not getting an oil change for the first while of their existence. I had no idea about this until I went back and read the contract. DT says the cars go through and pass a big inspection and I fell for that whole nonsense too.

I would absolutely love to get rid of it. If anyone finds a legal way, please PM me and I will fly to wherever you are and personally kiss your ass.
