    Default I'm mad! I want this apartment!

    We're looking to move and we found an apartment for $900/month. Thats cheap AND its a 3 bedroom. Its in a great town and everything. The average 2 BR apartment around here is $1000/month

    The paper stated "Adults only" but we figured hmm... maybe they just dont want teenagers or college kids.

    We call and the owner tells us we cant be considered because of our 2 year old. SO asks why and the man says its because the previuse tenant's kids ripped up the flooring.

    Erg... This really could have worked for us because we have a few friends looking to rent rooms. One of our friends is on the verge of being homeless with her 1 year old.

    Anyways... Can they do that? I understand if its not deleaded etc... but they simply dont want kids there?!

    Hmm well there going to have fun finding someone to rent a 3 BR without kids.

    I don't know about the Landlord/Tenant laws in you area, but I don't think they can say "no kids" for regular apartment rentals unless the units are specifically for elderly/retiree's and such. I can understand a "no pets" thing, but no kids? You should look into it.

    They can't say no kids, any more than they could say "no asians." But there are ways around it, like all things. The long and short of it is, you won't get this apartment. Sorry. I've had it happen to me, too.

    That sucks. Keep it in your radar. Maybe they'll have problems renting out a three bedroom apartment to someone who needs three bedrooms and doesn't have kids? Just trying to be optimistic.

    It is against the law to turn down a renter just because they have children with one exception: Senior communities. Turn this landlord in to HUD.

    Yep! My sister had the same thing happen to her. She found her dream apartment and they told her no because of her 3 year old. She reported it and they actually did something about it. The landlord even apologized. I don't know how often it actually gets fixed but it can't hurt to try, right?

    Usually no; but they can prevent you from renting out rooms or letting anyone who is not on the lease live there. "Living there" varies in meaning from 3 days to 2 weeks.

    You might consider how much you want to contest this - I had a similar issue with pets (in Ontario they can't refuse to rent to pets. Well, they can refuse to rent to pets, but not to people because they have pets). But seriously - you get in with a landlord who is constantly on your ass - especially if she or he is on the premises. It will make for a very hostile and unpleasant living environment.

    She can turn them in... but it wouldn't help her get the apartment. They'd for sure come up with some other reason. Let us know if you do anything, collegegirl.

    Really, they're being unreasonable about it. If the previous tenants kids ripped up the flooring... it's called a DEPOSIT. Geez.

    I have four kids and I don't think there unresonable at all and I think you should be allowed to say not kids. This is ther investment and they want it kept a certin way. The goverment should not be able to tell people how they can handle there private property unless its race or sexual prefeance but i think not wanting to have kids live there is acceptable and reasonable.

    While I agree with that and it kind of goes against the whole "this is a free country" thing... It's illegal to discriminate like that (Rozz gave the example that you can't say it any more than saying that Asians can't live there). I mean, someone could say, "Asian food leaves a weird smell in the carpets and I'd have to replace them" or... I dunno, that might be a bad example.

    ^^^ heh, I pay a deposit per pet to move in, then 50 a month to have them and if they destroy anything I have to pay for that too.. Talk about a rip off!
    Be glad they can't legally do that with human kids.

    Plus it is bit short sighted of the landlord/lady basing his/her judgement of your child(ren) based on the previous tenants! Each child is an individual. Just because one was distructive doesn't mean they all are ... damn!

    It is like saying all pet owners are irresponsible because the previous tenant's pets weren't well kept (and they were irresponsible).... landlord/lady's should only judge you upon your application only.

    That's what the RENTAL BOND is for is to replace stuff.

    Kids can be whirlwinds of terror, but tearing up carpet? Yikes.

    Renting sucks. Just because I'm enrolled at the university gets me turned down by tons of the places I like. Nevermind the fact that I'm not some crazed partier. But to say no children allowed? Geez. Just out of curiousity, do they allow pets?

    I hate to be the bad person here but that would make me SO happy - knowing that nobody around me had kids. I -wish- there were more places without kids around that I could rent. I'm so sick of hearing screaming after school or being woken up early in the morning to the neighbour yelling at her child (I know ALL of their names!!)...

    I mean, yeah, it's 100% illegal... but I wish I was a senior just so I could live in a place without children.

    My apartment even has a trampoline outside my window for them... *sigh*... every weekend I get NO sleep.. work late and wake up 3 hours later to kids screaming and jumping...

    *sigh*

    Yeah, it's totally illegal, but you're not going to get the apartment. It sucks that whoever lived there before ruined it for anybody with kids. Who lets their little ones tear up the flooring?

    Hmmm...maybe if you contacted this landlord and told them that you are sorry that they had such an issue with the last tenant, but assuring them your child is not destructive...and that you would be willing to put more of a security deposit down (refundable in full when you move out if there is no damage...make sure you keep before and after photos/videos with time/date stamp!!) to help "ease" their concerns. It may just work.

    I own a couple of properties and I wont permit smoking in them. Does that make me discriminative? Hell yeah, I dont want my places stinking of smoke. I second VG's comment. Offer a larger damage deposit.

    Yeah... that's just not the way it works. In most places you are not allowed to discriminate against people because they have children (along with a bunch of other reasons). The reason for this is, simply, that the decision to have a family is seen as an integral function of human dignity, and people with families need to live somewhere, and "child charges" have traditionally been exorbitant enough that it has been prohibitive to most people. Further most people accept that there needs to some kind of market correction for housing (because there is an inherent inequality - people need places to live a lot more than people need to provide them with a place to live) and that from an efficiency standpoint it is more sensible to put controls on discriminatory housing decisions than have a disproportionate number of members of a particular group be homeless, despite being fully employed and able to pay rent.

    Sheik - a big difference between disallowing smoking and disallowing children is that people can go smoke outside.

    But, yeah...it's ok to not allow smoking, etc. But, to not allow housing to families is a big no-no.

    Just because someone is a landlord doesn't mean that they know the legal ins and outs of landlording...nor does it mean that they are aware of what they can and cannot do. Being nice and offering to up the deposit could work.

    But, again, I stress that you need to take VIDEO of the place during your pre-move inspection tour WITH the landlord (get them in the video). Put that in a safe place. Then, when you are ready to move out, do the same tour WITH the landlord (in the video here too) and have them sign a statement that states the place is in good condition and that you will be receiving your full deposit back.

    Aye Aye. I like kids, but I'd love a place where I didn't have to worry about kids. I'd even pay extra to be on a long airplane flight without kids. Yeah there are some well-behaved ones, but a lot are loud, obnoxious little shits. Even if they're not little shits, kids still need to be energetic.

    One of my (and pretty much every Childfree person) pet peeves about kids is that we have to accomodate them at places like restaurants, where stupid breeders will say, "If you don't like it, stay home." Heh, do they stay home if there's smoking/provocative posters/insert sinful act that moo doesn't want her poor angels exposed to? NO! They piss and moan that the world isn't child-friendly, and try to change it. We live in a kid-centric world.

    Not all places are for kids. Is it discriminitory that kids can't go into porn stores? Or what if the landlord knows that people will piss and moan and complain about the kids? What if there was a lawsuit in the past in which a kid drowned in the pool becuase the parents were irresponsible shits? This happened in Houston. Even though the mom admitted to being a drug haze, the apartment complex still got sued.

    ^^^ Hear, hear. My first apartment was in a complex with a lot of kids, and I had the misfortune to rent a unit on ground level facing the pool. I was a sophomore in college, working over 40 hours a week and taking a 15-hour advanced courseload, and I wanted to strangle each and every one of those fucking kids. And I'm a person who LIKES kids. I would've paid much more for a child-free complex so that I could've actually gotten a little bit of sleep on the weekends.

    It's the landlord's property and he should have every right to decide who he will and won't rent to.

    People without kids, Childfree people, and people who want some peace and quiet have rights too. Unfortunately, all you have to do is put a cute little kid in the equation and the juries and public will always take the kid's side. This is why people who want kids to stop screaming and throwing tantrums in restaruants are crabby and mean, yet if I did the same in a public place, I'd be dragged away in handcuffs or a straitjacket.

    In fact, I'm willing to wager that the previous tenents whined their way out of having to pay for damages or even admitting that their little angels had done anything wrong. There's this strange concept, promoted by society, that kids can't be held liable for their actions. My daddy smacked my ass when I kicked in a wall at age 6. Anyway, the landlord very well may have had to pay for the damages.
