    "According to court documents, the problem began in May 2005 when Pearson became a judge and brought several suits for alteration to Custom Cleaners in Northeast Washington, a place he patronized regularly despite previous disagreements with the Chungs. A pair of pants from one suit was not ready when he requested it two days later, and was deemed to be missing.

    Pearson asked the cleaners for the full price of the suit: more than $1,000.
    But a week later, the Chungs said the pants had been found and refused to pay. That's when Pearson decided to sue."

    abusive lawsuits make me so angry.

    My local Orange County Weekly (free liberal newspaper... an oasis in OC) just ran an article about an asshole of a guy, ex drug-dealer/swindler, who got shot (or an accident... i forget) and ended up in a wheelchair, then decided his new swindling game would be to sue small mom& pop businesses for "handicap discrimination" if their specifications for wheelchairs weren't 100% up to federal or state standards.

    It's one thing to REQUEST a wheelchair ramp installation at a local flower shop or mediterranean grocery mart... it's another thing to state OUtRight discrimination and plunk down a multi-million dollar lawsuit, forcing these people out of business. schmuck.

    Hmm. I don't know about this. Because one of the things that ticks me off is places that could easily accommodate wheelchairs and just don't. Places with one step to get in, for example, or one or two steps down to the washroom. In Ontario the HRC has "reasonableness" built in in reference to wheelchair access, so "abuse" is not likely. But keep in mind that regardless of where you are, many "mom and pop" stores are resisting outlays of less than $500. As well, keep in mind that most places have mechanisms for negotiation - that is, a lawsuit will only occur after the business has refused to accommodate. Like, if the person sues for x millions, and instead of paying they simply install a wheelchair ramp for $500 - do you think that lawsuit will be successful? No, it will not. And I really, really can't imagine that any human rights code anywhere is demanding that mom and pop set ups have to install elevators or escalators to second floor walk ups or anything of that nature.

    Sorry - something that irks me personally, and I really don't know how much sympathy a lot of these "small businesses" really deserve in this particular area.

    True, but think about it like this. Since he's suing this business, and he KNOWS they are immigrants, they can't possibly continue to keep paying lawyer fees. They are thinking about moving back to Korea, just to get out of this drama.

    If he isn't careful he'll lose his credibility as a law offical. I know I would never go to a judge who supported such an outlandish law suit, I wouldn't think he is a good judge. He might just end up digging himself deeper than he expected.

    I have no words, other than that this man is an absolute fuckwad. It galls me that he not only made it so far in the legal system, but also feels entitled to abuse the law in such a manner. Things happen in the dry-cleaning business, and the cleaners offered to compensate him for the pants. Sick, sick, sick. Who does he think he is? I'm glad this made the press, and I hope they ream his ass for this. I feel sorry for the dry-cleaners...sigh.

    On the news story that I heard, the anchor said the dry cleaners offered the judge $1,200 (he might have said $12,000!) to drop the lawsuit. Personally, I think the judge was under too much stress and snapped, like the astronaut lady a while back.

    I mean, we all have our favorite outfits, the kind that we always seem to make more money when we wear them. Should we sue for lost wages if something happens to them?

    I have the complete story in the first post. Basically he came to pick up his pants and they coudn't find them. He told them that they would need to pay him back for the entire suit (not just the pants) and the suit was over $1000. They refused to pay him $1000. Then, they found the pants and tried to give them back and he refused them.

    He's an ass

    Those people should have covered the cost of the missing pants... I've had cleaners screw up my clothes and not cover the costs before and it's just wrong... Um, but 65M?! Over-reacting JUST A LITTLE! Hopefully, he'll come to his senses and drop this case.

    ^Yea, I read that. I meant that they should have INITIALLY said, "We'll take care of it" instead of, "Screw you, we're not paying" or whatever was said.

    I wonder if this judge has any friends... and what they're saying to him.

    I don't understand the basis of his lawsuit. The sign that says "Satisfaction Guaranteed", to me, would imply that you would have to be satisified with an actual service.

    When they lost his pants, there was no service to be provided as there was no item to be serviced. He would then only be entitled to receive compensation for what the suit was actually worth, not what he paid for it, providing they don't have a sign that says "Not responsible for lost, stolen or damaged goods".

    At that point, you are taking a risk putting your clothes in there anyway.

    Sorry, I should have been more clear... these places DO have ramps and such- I was speaking about REALLY ridiculous things like inconsistencies in bathroom handicap accessibility... like, inches of toilet height and such- not that businesses were AVOIDING it.... just that this guy went in and particularly LOOKed for discrepancies. He was a scam artist, a crook... and this was just his new deal under the guise of some f*cked humanitarianism. He'd been in jail a million times for drug charges, assault & battery, fraud.... yeah.

    The other amazing thing is that the lawsuit was not immediately thrown out. These poor dry cleaners have been having to pay lawyers to fight this for over a year.

    The bonus is that the judge is coming up for a term renewal and they are recommending against keeping him in office.

    I can understand wanting and receiving compensation for lost stuff. I can understand never going to a place again due to crappy service. I can understand warning others about avoiding a place with crappy service. This is ridiculous. Aren't there rapists, robbers, and murderers out there who need to be in the courtroom instead?

    Another reason we need adopt a "loser pays" principle regarding litigation here in U.S. Maybe people would think a little bit before suing on weak grounds if they knew they could be held responsible for the other parties' legal expenses.

    Or maybe, we could just take Shakespeare's suggestion.

    Regarding the wheelchair ramp thing, I don't see why ANY privately owned business should be legally forced to make their business accessible to everyone. Simple good business sense should dictate that they make it such. If people can't get into your store, they can't spend money there. I doubt the professional litigant who was suing those small businesses intended to spend any anyways.

    See, this is why Australia made me so happy... you can't legally claim anything over a certain amount. Like rape is a maximum of 600k... but it depends on factors. Did you lose your hearing? Your sight? We're limbs broken, how many? Are you mildly, moderately or strongly mentally effected? Each one is a % totalling to over a 100% but can only equal 100% total of the money. Each situation has a grid like this. Makes MUCH more sense. o.o;
