    So I'm guessing she thought he was in violation of a health code on his property, does that constitute probable cause which would allow her to enter the property without a warrant, or is the guy with the video camera really right?

    ummmm by law, arent we allowed to shoot anyone who tresspasses? at least in my state i think you can if you ave signs posted "private property" and he told tem over and over and over....i think the guy in the video is right!

    Amendment IV

    The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

    Doesn't matter what your State or County Law is let alone a Federal one. This is the Law; any of those Authoritities to enter would draw upon. She can view the Property from the Road. If she sees violations from the Road the violation would have to constitute and immediate threat to Life, Limb, or Eyesight. That is the Plain View Doctrine. Deputy Chubby will be a Mall Cop making Court Ordered restitution payments if he doesn't wise up. The "Official" must be an acolyte of the Church of Enviromentalism. Concerns do not over ride laws. She should have a Warrant that States explicitly what she is looking for. Blank warrants are not permissable.
