    Default Could I Sue?

    Today i bought some kind of rotten apple juice from wal-mart it was their brand too. It smelled like beer kind of like a yeasty smell and had like carbonation to it. It was 100% apple juice though YUK my poor son poured a cup before i knew it was bad and cryed it tasted so awful The date on it was 5/24/08

    than my BF tasted and smelled it and was like EEWWWW

    Im woundering if I can come up with a way to get some sort of proof that it made some one in the house sick if i can sue wal-mart or tell them I am going to sue and get them to settle out of court.......

    A friend of a friend of mine got like 50000 out of wal mart when a Pallet of stuff barely bumped into her pregnant belly so I should certainly be able to sue over rotten or somthing added to apple juice right! how would i go about this? or would it be a waste of my time

    How to Sue Wal-Mart


    Interested in filing a lawsuit against Wal-Mart? Then check out the Wal-Mart Litigation Project, which comes complete with a list of cases in which people have sued Wal-Mart and won. The list appears to be a bit out of date, and it seems far too short to be comprehensive, but it’s still interesting to look at.

    One thing that I learned from persuing the list of verdicts is that Wal-Mart seems to be a haven for the uncoordinated. Sure enough, read through it and you’ll see that a great many of the litigants simply have trouble staying upright. One of my favorite cases is that of the Oklahoma man who injured his “sphincter muscle nerve” when the climbing equipment he purchased at Wal-Mart gave way, causing him to fall out of a tree. He was awarded $213k, and his wife took in an additional $34k for “loss of consortium” (see definition #3).
    The site also contains a variety of other interesting tidbits, including the fact that Wal-Mart is sued, for one reason or another, two to five times per business day in federal court alone. Another thing that you’ll learn is that Wal-Mart is very reluctant to settle out-of-court. I would be, too, if I got sued as much as they do. Finally, according to the site, juries seem reluctant to award large judgments to people suing Wal-Mart, and many attorneys are apparently reluctant to file suit against them. Fortunately for you, the site also has a searchable database of “Lawyers Who Sue Wal-Mart.” So what are you waiting for?

    Now that you just posted this publicly and admitted that no one was actually sick or hurt by it, I highly doubt that you will be getting anything but a free juice box from them. I am sure you are a sweet person and it's not all your fault, its society but...

    This is exactly why our litigious society sucks a big fat hairy ass.

    Oh good hell. Grow up. Shit happens, and ya know what, I'm all for suing when justified, but stupid lawsuits like this is why a) american's look like dumbass for being 'sue happy', and b) why big corporations spend more money on lawyers than giving their employees pay raises.

    No one is sick yet. And if they do get sick than hell yeah im sueing!! and have every right too.

    As for "shit happens" when you go to the store to buy food you should be able to trust that it is safe!

    Wal-mart is greedy as hell anyways and deserves to be sued and apparently by the article i just posted they are sued quite often.

    Look I have to add that a while ago there was a very long thread started by you about how you were going to marry a man who wanted to get a green card and he paid you and it all fell through.

    I was one of the few who stood up for u when everyone flamed you because I thought he was just as much at fault.

    However after reading this I think I see a pattern of dishonesty and lack of morals with you.

    You take it back to the store for a refund or a fresh bottle. Or you just throw it out and acknowledge that shit happens. It's spoiled apple juice, for heaven's sake, not a severed artery. You know by the smell not to drink it. If anyone in your house is still drinking it then they deserve to get sick.

    I agree that Wal-Mart is evil but suing over spoiled apple juice is every bit as evil as it is asinine.

    Ahem. "coming up with a way to get some proof" does not give you the RIGHT to sue anyone. It just makes you a liar trying to screw someone else out of money, corporation or not. Keep in mind, suing a huge corporation doesn't hurt the big wigs that "deserve" it, it hurts the employees down the chain trying to feed their damn families.

    You should really look back if your going to comment on that thread again because I was married to him for 2 years!!! Not getting ready to marry him. The marriage did not fall through the point of the whole thing fell through!

    No one got sick from it. You should have simply taken it back to the store but instead u thought u would be greedy and dishonest and abuse the legal system and try to get MONEY for NOTHING.

    Why dont u just work hard for money instead of contemplating committing perjury.

    Aren't u are great role model for your son?

    Anyway for what it's worth you wont get very far. Your mentality is what is wrong with society.

    I worked in the medical claims division of a law firm in Austin, an evil law firm that represented Wal Mart against worker's compensation claims. On one hand, you're right, Wal Mart does deserve to be punished. Almost all of the worker's compensation claims (some were extremely legitimate, i.e. the spinal cord injuries) were denied outright, and since the evil law firm I worked for was so powerful, many workers did not win their case.

    So I really doubt you'd get any money off of a Wal Mart lawsuit.

    This whole post reminds me of Arkansas for various reasons (I used to live there).

    I think you should sue so the judge can laugh in your face and then you will be stuck with not only your legal bills but when Wal- mart counter sues your ass you will be stuck paying their fees as well!!!

    I havent done anything just contimplating the idea woundering if its possible I did return the Juice and bought a different brand its the point that it should have never been put on the shelf in the first place. It should not have happened PERIOD.

    Sue Them Go Ahead- I'm Sure You Will Hire The Best Lawyer In The Business- Go For It.... While Your Are At It, Put A Neck Brace On And Tell The Judge That You Drank The Juice And You Lost Your Equilibrium And It Caused You To Fall And Hurt Your Self. Oh And Don't Forget The Crutches... A Jury Always Feels Remorse For A Girl With A Neckbrace On Crutches!
