    Default Is this legal? Not being hired, because of present job?

    My mom put in an application for a job at the local (government funded) Head Start center. She currently has a job and when she went for the interview told the lady that she currently has a job, but is looking to change.

    Well, one of the people that work there told her today, that when it was time to fill the position the center was going to call her, but another employee of the center said that she already had a job, she didnt need a job, and not to hire her.

    So they offered the job (and hired) someone else.


    Is this even legal??

    I am LIVID!

    Based upon my previous experience working at a Head Start I would suggest she call or visit the Director of that particular location to reiterate that she wants a change and is in fact looking for a job. It sounds like this other person was being snotty and felt that your mom didn't need a job since she already had one and believed that someone (probably a friend or acquaintance) without a job deserved it more. Is she looking for a teaching position or admin? Regardless, have her touch base with the Director (not a Head Teacher.)

    My mom isnt one to "rock the boat" and will probably never complain. It REALLY pisses me off, to the point that I want to go to the director about it, but since it didnt happen to me...

    The employee making the particular statement was way out of line and should at least be notified or reprimanded to not make such statements in front of applicants. If the center is an equal opportunity employer, then the decision has to be based upon qualification, not need of employment. Granted, behind closed doors I am sure if two equal applicants were to be discussed, the "already has a job" statement might make sense to the human resource department, but as I said, that should be behind closed doors.
