    Apparently the government is would like to shut down adult recreation sites. Sounds nutty to me!

    The actual term that the article uses is "adult social-networking sites." I think--but I'm not sure-- that means sites like adultfriendfinder.com or iwanttoputmydicksomeplacewarmrightnowplz.net, etc. Although SW naturally enables strippers to get to know one another, we're not a networking site in the usual sense of the word, a la Myspace or even Eharmony or whatever.

    At least I hope this is the case. SW dies, TotH dies. It's that simple and that sad.

    Honey. That's just a blog. Section 2257 is related to record keeping for pornography (visual pornography). I think it means that Pryce would be either obligated to keep records on people who post sexually explicit photos or stop people from posting sexually explicit photos. So, no. I don't think the bill is trying to shut stripperweb down. Although that doesn't mean you hae to like the addition to the bill.

    Let's say the govt decided that they want to expand the nanny state, and ban AFF.com? And Stripperweb? Any site they don't like...banned?

    What would stop Pryce from moving SW to being hosted in Europe? Or Canada? Or wherever? Could they still "get him?"

    ^ The "government" -- do you mean the executive branch? -- could certainly try to ban web sites they do not favor. But nobody in this town is even remotely close to being that monumentally stupid.

    For one, it would be overturned in a flash by any federal district court. The DC circuit would kill it as soon as the ACLU and a dozen civil liberties organizations appealed to the DC circuit court to impose an injunction on any such action as a direct violation of free speech, with so many precedents that I couldn't even begin to list them all.

    And I assure you, I would have my own attorneys file an amicus curiae brief on behalf of SW if anybody got within a country mile of threatening this site. That would assume the ACLU had already filed to block any action by the executive branch. If they didn't make any such filing, I certainly would instruct my attorneys to. And they are bad-ass $750 an hour predators who eat federal prosecutors for a light snack. They don't even qualify for lunch.

    There be some serious money and influence behind SW. I know, it's hard to believe, but if anybody tries to fuck with us, they would regret for all time the shitstorm that would follow. They would hit an impenetrable legal wall with us, and certainly decide to take their battles to easier battlegrounds.

    I did some fairly substantial research into the de-facto possibilities of Section 2257 prior to my decision to abandon my adult pay website. In response to your questions ...

    as long as the website 'owner' still lives in the USA, and as long as website content is being 'served' to US web surfers, operating from a foreign web host doesn't help a bit in terms of theoretical legal liabilities for violations of Section 2257

    there is a large gray area of interpretation in regard to exactly what constitutes 'sexual content' re web pics that would make them subject to Section 2257 regulations. Potentially, a pic with a girl touching her own breast could be considered to contain 'sexual content', thus making the 'owner' of a website posting such a pic potentially responsible for Section 2257 compliance and potentially subject to Section 2257 prosecution

    The biggest 'hammer' stemming from Section 2257 is the fact that a mere accusation / charge of possibly violating Section 2257 goes on record as being charged with a US federal 'sex crime' felony. As Other Owner points out, a good defense lawyer could make mincemeat of such charges in a US federal court unless the specifics of the Section 2257 violation are BLATANT. However, merely GETTING before a federal court with a competent legal defense is going to cost the website 'owner' tens of thousands of dollars ... which is typically far more than the website generates in profits.

    In the absence of a generous benefactor like Other Owner or in the absence of huge website profits to pay for a heavy hitting legal defense, a great deal of pressure will be exerted on the accused website 'owner' to cop a plea - which in turn can lead to the website 'owner' having little choice but to make a de-facto guilty plea to a misdemeanor federal 'sex crime'. This in turn can trigger all sorts of downstream effects, such as being automatically rejected by potential straight job employers, such as being legally required to report your 'sex offender' status to local cops and neighbors, such as being forced to move out of your house if it is located with 1000ft of a school / park / church ...
